SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/07\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioner who is holding industrial plot in G.I.D.C. Engineering<br \/>\nEstate, Gandhinagar has prayed for an appropriate writ, order or<br \/>\ndirection directing the respondent to allot one plot to the<br \/>\npetitioner for residential purpose.\n<\/p>\n<p>2.\tIt<br \/>\nis the case on behalf of the petitioner that as petitioner is holding<br \/>\ntwo plots in G.I.D.C. Engineering Estate of Gandhinagar in Sector 28,<br \/>\nwhich are used for industrial engineering purpose.  As per the policy<br \/>\nof the G.I.D.C., he is entitled to one plot for residential purpose.<br \/>\nHe has submitted that infact under the guise that 20% quota for<br \/>\nallotment of residential plot to the engineering units is already<br \/>\nexhausted, even petitioner has not been issued the form. It is the<br \/>\ncase on behalf of the petitioner that there is no such policy of 20%<br \/>\nceiling.  It is, therefore, submitted that the case of the petitioner<br \/>\nbe considered alongwith other applications which are pending since<br \/>\n2005.\n<\/p>\n<p>3.\tAffidavit-in-reply<br \/>\nis filed on behalf of respondent.  It is categorically stated that as<br \/>\nsuch there is a scheme\/policy which is consistently followed by the<br \/>\nG.I.D.C. That 20% of the residential plots are reserved for the<br \/>\nengineering units and 20% are reserved for employees and there are<br \/>\nother reservations also.  It is submitted that last allotment of<br \/>\nresidential plot was made in the year 2005 and thereafter, the<br \/>\nG.I.D.C. has stopped allotting residential plots to the owners of the<br \/>\nengineering units as their quota is exhausted.  It is further<br \/>\nsubmitted that even otherwise petitioner is not entitled to the<br \/>\nresidential plot in as much as wife of the petitioner, who is also<br \/>\nJoint Director in the company of the petitioner i.e. Biocare Remedies<br \/>\nPrivate Limited, was infact allotted one residential plot considering<br \/>\nthe policy prevailing at that time and wife of the petitioner has<br \/>\nsold the said plot by registered sale deed executed in the year 2009.<br \/>\n Therefore, it is submitted that infact as one plot was already<br \/>\nallotted, petitioner is not entitled to second plot.  It is further<br \/>\nsubmitted that even otherwise considering the aforesaid conduct, it<br \/>\nappears that petitioner does not want to use the residential plot<br \/>\nwhich may be allotted to him for residential purpose as the plot<br \/>\nwhich was already allotted to his wife, is already sold.  It is<br \/>\nsubmitted that plot is to be allotted for their own use and<br \/>\nresidential purpose.  Therefore, it is submitted that even otherwise<br \/>\npetitioner is not entitled to residential plot.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned advocates appearing on behalf of respective parties, it<br \/>\nappears that as such petitioner is Managing Director of one Biocare<br \/>\nRemedies Private Limited who has industrial engineering plots and for<br \/>\nthe purpose of allotment they are clubbed together and the Joint<br \/>\nDirector of the said company i.e. wife of the petitioner was infact<br \/>\nallotted one residential plot as per the policy of the G.I.D.C..<br \/>\nHowever, wife of the petitioner has sold the said residential plot by<br \/>\nexecuting registered sale deed in the year 2009.  As per the policy,<br \/>\none of the Director and\/or partner is entitled to residential plot<br \/>\nand the wife of the petitioner being Joint Director of the company of<br \/>\nthe petitioner was allotted residential plot which is sold.  Now<br \/>\nagain, the petitioner wants a residential plot.  It is to be noted<br \/>\nthat the residential plot is required to be given for their own<br \/>\nresidential use and purpose and not for the purpose of sale.  As<br \/>\nstated hereinabove, the wife of the petitioner who was allotted<br \/>\nresidential plot as Joint Director of the Company has sold the plot<br \/>\nand not used the plot for their own residential purpose.  It is<br \/>\nsubmitted that as wife of the petitioner is staying at Ahmedabad and<br \/>\nthe residential plot was at Gandhinagar, she has sold it.  It is to<br \/>\nbe noted that petitioner is staying with his wife at Ahmedabad.<br \/>\nTherefore, there are all possibilities that the petitioner will not<br \/>\nuse the residential plot.  As stated hereinabove, the plot which was<br \/>\nalready allotted to the wife of the petitioner is sold by executing<br \/>\nsale deed in the year 2009. Under the circumstances, prayer of the<br \/>\npetitioner to direct the G.I.D.C. to allot residential plot to the<br \/>\npetitioner, cannot be granted.\n<\/p>\n<p>5.\tEven<br \/>\notherwise, considering the affidavit-in-reply, it appears that there<br \/>\nis some quota and the residential plots to be allotted to the owners<br \/>\nof the engineering units is exhausted.  It is true that no such<br \/>\npolicy\/scheme is forthcoming.  However, as stated in the<br \/>\naffidavit-in-reply, it is consistent practice and not only that,<br \/>\ninfact the G.I.D.C. has  stopped allotting residential plots to the<br \/>\nowners of the engineering units since year 2005 and no other plot<br \/>\nholders having engineering units are allotted any residential plots<br \/>\nthereafter.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above and for the reasons stated above, there is no<br \/>\nsubstance in the petition which deserves to be dismissed and is,<br \/>\naccordingly, dismissed.
