           Slapped with the concurrent findings against<\/p>\n
the plaintiffs, they have come up in appeal.<\/p>\n
           2. The suit was one for declaration of title and<\/p>\n
possession and for setting aside the survey proceedings.<\/p>\n
The plaint consists of A and B schedule items, title to<\/p>\n
which are traced by the plaintiffs through Exts.A1 and<\/p>\n
A4. According to the plaintiffs, resurvey mistakes were<\/p>\n
committed by the authorities and that has resulted in<\/p>\n
showing a portion of the property which was actually<\/p>\n
belonged to the plaintiffs as puramboke land.                            After<\/p>\n
exhausting the statutory remedy, they have come up for<\/p>\n
rectification of records and for other reliefs.<\/p>\n
           3. The State resisted the suit. They justified<\/p>\n
the survey and contended that the plaintiffs are not<\/p>\n
entitled to any relief.\n<\/p>\n

             4. On the basis of the pleadings, necessary issues<\/p>\n
were raised by the trial court. The evidence consists of the<\/p>\n
testimony of P.W.1 and documents marked as Exts.A1 to<\/p>\n
A11 from the side of the plaintiffs.           The defendants<\/p>\n
examined D.W.1. Exts.C1 and C1(a) are the report and plan<\/p>\n
prepared by the commissioner.\n<\/p>\n
             5. The trial court found that except the two<\/p>\n
partition deeds, based on which title was traced to the<\/p>\n
plaintiffs, no other document is produced by the plaintiffs to<\/p>\n
establish title to the suit property. The trial court noticed<\/p>\n
that      the partition deeds are usually not taken as<\/p>\n
documents of title and the plaintiffs for reasons best known<\/p>\n
to them chose not to produce any           other document to<\/p>\n
establish their title to the suit property. It has also to be<\/p>\n
noticed that they had taken no steps to have the survey or<\/p>\n
resurvey records produced        before the court.   Based on<\/p>\n
these findings the suit was dismissed.\n<\/p>\n
             6. The plaintiffs carried the matter in appeal as<\/p>\n
A.S.314 of 1994, the appellate court for the very same<\/p>\n
S.A. 603\/1999.                  3<\/span><\/p>\n
reasons as that found by the trial court, dismissed the<\/p>\n
appeal. Hence this second appeal.\n<\/p>\n
             7.  Notice has been issued on the following<\/p>\n
substantial questions of law:\n<\/p>\n
             “A. Whether the re-survey plan prepared by<\/p>\n
      the authorities are final?\n<\/p><\/blockquote>\n
             B.  Are not the courts below bound to<\/p>\n
      consider the contentions of the parties against the<\/p>\n
      re-survey on the basis of the documents produced<\/p>\n
      by the parties?\n<\/p><\/blockquote>\n
             C. Whether patta alone will prove title and<\/p>\n
      possession of the parties<\/p>\n
             D. Are not the findings of the courts below<\/p>\n
      wrong in view of its failure to consider the scope<\/p>\n
      of Act 37 of 1961?”\n<\/p><\/blockquote>\n
             8. Learned counsel appearing for the appellants<\/p>\n
pointed out that the courts below have erred both on facts<\/p>\n
and in law in dismissing the suit.      According to learned<\/p>\n
counsel the commission report and the plan are not properly<\/p>\n
considered and that has resulted in miscarriage of justice.<\/p>\n<\/blockquote>\n
The commissioner has identified the properties and the<\/p>\n
S.A. 603\/1999.                  4<\/span><\/p>\n
finding of the courts below that the plaintiffs have not<\/p>\n
produced prior documents of title deeds cannot be<\/p>\n
countenanced.\n<\/p>\n
             9. Though the argument may look attractive, it<\/p>\n
has to be said that it is without basis. As rightly pointed out<\/p>\n
by the courts below the partition deed is not usually taken<\/p>\n
as document of title. It is well settled that partition is only a<\/p>\n
division of status, where one person is given exclusive right<\/p>\n
over a portion of the property in lieu of giving up claim over<\/p>\n
rest of the property. The person has pre-existing right to the<\/p>\n
property. It is surprising to notice that even after the trial<\/p>\n
court had noticed that the document of title had not been<\/p>\n
produced by the plaintiffs to establish their title, there was<\/p>\n
no attempt on the part of the plaintiffs to produce the<\/p>\n
document of title at the appellate stage.       They remained<\/p>\n
satisfied with whatever they had produced before the trial<\/p>\n
court. It is not discernible from the commission report or<\/p>\n
plan as to on what basis the sketch has been drawn by the<\/p>\n
commissioner. It does not refer to any particular document<\/p>\n

of title which could have been handed over to him by the<\/p>\n
plaintiffs at the time of preparing the report and plan.<\/p>\n
             10.    The   plaintiffs traced  title to   various<\/p>\n
documents, which they have not produced.             It is also<\/p>\n
surprising to note that they felt it unnecessary to have either<\/p>\n
the survey or resurvey sketch produced. There was also no<\/p>\n
attempt to have the properties identified with respect to the<\/p>\n
survey and resurvey plan. It was under those circumstances<\/p>\n
that both the courts below were compelled to hold that there<\/p>\n
is nothing to indicate that the resurvey authorities      have<\/p>\n
erred in any manner in conducting the survey and coming to<\/p>\n
the conclusion that a portion of the property in the<\/p>\n
possession       of the plaintiffs is puramboke land.       No<\/p>\n
justifiable grounds are made out to interfere with the<\/p>\n
judgments and decrees of the courts below.<\/p>\n
             Further, the findings of the courts below      are<\/p>\n
based on appreciation of evidence and it is a finding on fact.<\/p>\n
No substantial question of law, much less any substantial<\/p>\n
question of law arises for consideration in this Second<\/p>\n
S.A. 603\/1999.                6<\/span><\/p>\n
Appeal.       This Second Appeal is without any merits<\/p>\n
whatsoever. It is accordingly dismissed. Accordingly, there<\/p>\n
will be no order as to costs.\n<\/p>\n<\/p>\n
