Justice V.GIRI\n\n Dated :17\/07\/2009\n\n O R D E R\n                              V.GIRI,J.\n                        -------------------------\n                   W.P ( C) No. 17722 of 2009\n                       --------------------------\n                  Dated this the 17th July,2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioners are 4th year B.Pharm students studying<\/p>\n<p>in the Nirmala College of Pharmacy, Muvattupuzha. They<\/p>\n<p>are now aggrieved that they have not been permitted to<\/p>\n<p>continue their prosecution of 4th year course on the<\/p>\n<p>premise that they have not cleared all the papers in the<\/p>\n<p>second year.\n<\/p>\n<p>      2.    Going by the regulations as pleaded by the<\/p>\n<p>University, it is true that persons who have not cleared all<\/p>\n<p>the papers in the 2nd year should not be permitted to<\/p>\n<p>attend the classes.      But as is seen from the counter<\/p>\n<p>affidavit filed by the University in fact the petitioners had<\/p>\n<p>attended the 3rd year course and had given the<\/p>\n<p>examination for the 3rd year also after being issued hall<\/p>\n<p>ticket in this regard.\n<\/p>\n<p>      3.    In these circumstances, I am of the view that<\/p>\n<p>petitioners should be permitted to attend the 4th year.<\/p>\n<p>W.P ( C) No. 17722 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Obviously, petitioners can appear for the 4th year<\/p>\n<p>examination only after clearing the       2nd year papers in<\/p>\n<p>entirety.\n<\/p>\n<p>      Subject to the above, writ petition is disposed of .
