The order of detention is<br \/>\n\tassailed by the detenu on various grounds mentioned in the memo of<br \/>\n\tthe petition. However, learned counsel for the detenu submits that,<br \/>\n\texcept FIRs registered under the Bombay Prohibition Act, there was<br \/>\n\tno other material before the detaining authority whereby it could be<br \/>\n\tinferred reasonably that the detenu is a &#8216;bootlegger&#8217; within the<br \/>\n\tmeaning of Section 2(b) of the Act and required to be detained as<br \/>\n\tthe detenu&#8217;s activities are prejudicial to the maintenance of<br \/>\n\tpublic health and public order. In support of the  above submission,<br \/>\n\tlearned counsel for the detenu has placed reliance on judgment of<br \/>\n\tthe  Apex Court in the case of <a href=\"\/doc\/1169973\/\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner of<\/a> police, AIR 1989 Supreme Court<br \/>\n\t491 and the recent judgment dated 28.3.2011 passed by the<br \/>\n\tDivision Bench of this  Court [Coram: S.K. Mukhopadhaya C.J. &amp;<br \/>\n\tJ.B. Pardiwala, J].] in<br \/>\n\tLetters Patent Appeal No2732 of 2010  in Special Civil Application<br \/>\n\tNo.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner of Police)<\/a><br \/>\n\twhich would squarely help the detenu.\n<\/p>\n<p>Learned<br \/>\n\tAssistant Government Pleader submitted that registration of FIR<br \/>\n\twould go to show that the detenu had, in fact, indulged into such<br \/>\n\tactivities, which can be said to be disturbing the public health and<br \/>\n\tpublic order and in view of sufficient material before the detaining<br \/>\n\tauthority to pass the order of detention, no interference is called<br \/>\n\tfor by this Court in exercise of its power under Article 226 of the<br \/>\n\tConstitution of India.\n<\/p>\n<p>Having<br \/>\n\theard the rival submissions of the parties and perused the record of<br \/>\n\tthe case, I am of the view that FIRs registered under the Bombay<br \/>\n\tProhibition Act alone cannot be said to be sufficient enough to<br \/>\n\tarrive at subjective satisfaction to the effect that the activities,<br \/>\n\tas alleged, are prejudicial to the public order or lead to<br \/>\n\tdisturbance of public order. There has to be nexus and link for such<br \/>\n\tactivities with disturbance of the public order. On careful perusal<br \/>\n\tof the material available on record and the ratio laid down by the<br \/>\n\tApex Court in the case of Piyush Kantilal Mehta (supra) and the<br \/>\n\trecent judgment dated 28.3.2011 passed by the Division Bench of this<br \/>\n\t Court [Coram: S.K. Mukhopadhaya C.J. &amp; J.B. Pardiwala, J].] in<br \/>\n\tLetters Patent Appeal No2732 of 2010  in Special Civil Application<br \/>\n\tNo.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner of Police),<br \/>\n\tI<\/a> am of the view that the activities of<br \/>\n\tthe detenu cannot be said to be in any manner prejudicial to the<br \/>\n\tpublic order and therefore, the order of detention  passed by the<br \/>\n\tdetaining authority cannot be sustained and is required to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The order of<br \/>\n\tdetention dated 5.8.2011 is hereby  quashed and set aside. The<br \/>\n\tdetenu, is ordered to be set at liberty forthwith if the detenu is<br \/>\n\tnot  required in connection with any other case. Rule is made<br \/>\n\tabsolute accordingly.
