THE CHILD DEVELOPMENT PROJECT OFFICER,\n                  MADHUBANI.                 ..................RESPONDENTS.\n                                -----------\n<\/pre>\n<p>2   25.02.2011              A    supplementary         affidavit       has     been<\/p>\n<p>                 filed by the petitioner enclosing an order of<\/p>\n<p>                 the   Commissioner           dated   17.08.2010         by   which<\/p>\n<p>                 the   revision         of    the     petitioner      has     been<\/p>\n<p>                 dismissed as not maintainable.<\/p>\n<pre>                            From        the     new        Guidelines         dated\n\n                 14.06.2010,       issued       under      the     signature     of\n\n                 Principal       Secretary       of    the    Department,       it\n\n<\/pre>\n<p>                 appears that, under paragraph 8, a specific<\/p>\n<p>                 provision has been made for a revision before<\/p>\n<p>                 the Divisional Commissioner against the order<\/p>\n<p>                 of the Collector passed in the appeal. The<\/p>\n<p>                 revision has to be filed within 30 days and<\/p>\n<p>                 the   Divisional        Commissioner,           after    hearing<\/p>\n<p>                 the parties, has to dispose of the same by a<\/p>\n<p>                 reasoned       order    within       60    days    thereafter.<\/p>\n<p>                 Therefore, apparently, when the Commissioner<\/p>\n<p>                 rejected the revision of the petitioner by<\/p>\n<p>                 order dated 17.08.2010,                on the ground that<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>          the    same   was    not    maintainable,     he    had    the<\/p>\n<p>          power to entertain the revision under this<\/p>\n<p>          new Guidelines.\n<\/p>\n<pre>                    Therefore,         the     order         of      the\n\n          Commissioner        dated   17.08.2010   is    set      aside\n\n<\/pre>\n<p>          and he is directed to restore the revision of<\/p>\n<p>          the petitioner, consider the same on merits,<\/p>\n<p>          hear    the     parties       and   decide     the        same<\/p>\n<p>          positively within the time frame fix in the<\/p>\n<p>          Guidelines for deciding such revision.<\/p>\n<p>                    The writ application is disposed of<\/p>\n<p>          with      the       aforesaid       observations           and<\/p>\n<p>          directions.\n<\/p>\n<p>                    If any appointment is made during the<\/p>\n<p>          pendency of the revision of the petitioner,<\/p>\n<p>          the same shall be subject to the final result<\/p>\n<p>          of the revision.\n<\/p>\n<\/p>\n<pre>Arvind\/                           ( J.
