Respondents<\/p>\n<p>are the defendants. Appellants filed the suit seeking<\/p>\n<p>a decree  for  declaration of right  of way  by  easement<\/p>\n<p>of   prescription   and   necessity   and   for   consequential<\/p>\n<p>decree   for   injunction.   Appellants     contended   that   38<\/p>\n<p>cents   in   survey   No.951\/2   of   Athirampuzha   village<\/p>\n<p>belonged   to   their   uncle   Thomas   Karimpukalayil   and<\/p>\n<p>under   Ext.A1   sale   deed   dated     2\/2\/1961   he   assigned<\/p>\n<p>the property in their favour and while so,   10 cents<\/p>\n<p>of the property was gifted to Polaparayil Aleyamma in<\/p>\n<p>1968   and   Government   acquired                3   cents        of   the<\/p>\n<p>property   for   the   purpose   of   Kottayam   Medical   College<\/p>\n<p>and   as   a   result   of   severance   of   the   property   by<\/p>\n<p>acquisition,   no   way   is   available   to   the   remaining<\/p>\n<p>property  in   the   possession   of   the   appellants   and   the<\/p>\n<p>way   to   the   plaint   schedule     property   is   from   the<\/p>\n<p>southern   panchayat   road   where   a   gate   has   been<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>installed   by   the   Medical   college   and   that   way   is   being<\/p>\n<p>used   by   plaintiffs   and   their   predecessors   for   the   last<\/p>\n<p>more   than   50   years   peaceably   openely   and   as   of     right<\/p>\n<p>and   as   an   easement   and   they   are   therefore   entitled   to   a<\/p>\n<p>declaration of right of way by easement of prescription as<\/p>\n<p>well as necessity. Defendants disputed claim and contended<\/p>\n<p>that there is no way to plaint  schedule  property towards<\/p>\n<p>south and property of the Medical college  on the southern<\/p>\n<p>side of plaint schedule property was enclosed   by a fence<\/p>\n<p>and appellants are not entitled to decree for declaration<\/p>\n<p>or   injunction.     Learned   Munsiff   framed   necessary   issues.\n<\/p>\n<p>On   the     evidence   of   Pws.1   to   5     and   Exts.A1   to   A9     and<\/p>\n<p>DW1   and   Exts.B1   to   B6   and   Ext.C1,   learned   Munsiff   found<\/p>\n<p>that appellants did not establish a right of way either by<\/p>\n<p>easement   of   prescription   or   easement   of   necessity   and<\/p>\n<p>therefore   held   that   they   are   not   entitled   to   the   decree<\/p>\n<p>sought for. Suit was dismissed.  Appellants challenged the<\/p>\n<p>decree   and   judgment   before   Sub   court,   Kottayam   in<\/p>\n<p>A.S.51\/96.   Learned   Sub   Judge   on   re-appreciation   of<\/p>\n<p>evidence,   confirmed   the   decree   and   judgment     passed   by<\/p>\n<p>learned   Munsiff   and   dismissed   the   appeal.   Before   the<\/p>\n<p>learned   Sub   Judge   appellants   did   not   press   the   claim   for<\/p>\n<p><span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>right of easement  by prescription and only contended that<\/p>\n<p>they have a right of easement by necessity.\n<\/p>\n<p>      2.    This   second   appeal   is   filed   challenging     the<\/p>\n<p>concurrent   decree   and   judgment   passed   by   courts   below.\n<\/p>\n<p>Learned counsel appearing for appellants vehemently argued<\/p>\n<p>that evidence establish that the only way available to the<\/p>\n<p>plaint   schedule   property   is   from   the   southern   panchayat<\/p>\n<p>road   which   runs   through   the   property   of   Medical   college<\/p>\n<p>and   When   southern   portion   of   the   property   covered   by<\/p>\n<p>Ext.A1   was        acquired,   appellants   lost   access   to   the<\/p>\n<p>remaining property  and therefore courts below should have<\/p>\n<p>upheld the claim for right of easement by necessity.\n<\/p>\n<p>      3.    On hearing  learned counsel and on going through<\/p>\n<p>the   judgments   of   courts   below,   I   do   not   find   any<\/p>\n<p>substantial   question   of   law   involved            in   the   second<\/p>\n<p>appeal.   Right   of   easement   by   prescription   though   claimed<\/p>\n<p>in   the   suit,   before   the   first   appellate   court   it     was<\/p>\n<p>given   a   go   by.   Only     right   of   easement   by   necessity   was<\/p>\n<p>pressed.\n<\/p>\n<p>      4.    Appellants     claim   title   and   possession   of   the<\/p>\n<p>property     under   Ext.A1.   Ext.A1   which   came   into   existence<\/p>\n<p>in       1961   shows   the     eastern   boundary   of   the   property<\/p>\n<p><span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>covered   under   Ext.A1   was       &#8220;Nattuvazhy&#8221;  (a   public   way).\n<\/p>\n<p>Appellants  cannot contend that the way to plaint schedule<\/p>\n<p>property   was   from   the   southern   side   or   that   by   severance<\/p>\n<p>of property that way was lost. As rightly found by courts<\/p>\n<p>below   right   of   easement     by   necessity   would   arise   only<\/p>\n<p>when   there   was   a   splitting   up   of   the   tenement   whereunder<\/p>\n<p>property   left   with   appellants   cannot   be   enjoyed     without<\/p>\n<p>making use of the acquired property as a way. When Ext.A1<\/p>\n<p>shows that there is access to the remaining property when<\/p>\n<p>the   southern   portion   of   Ext.A1   property   was   acquired,<\/p>\n<p>appellants   cannot   claim   a   right   of   way   through   the<\/p>\n<p>acquired   plot.   As   per   Ext.A1,   the   eastern   boundary   is   a<\/p>\n<p>way.   It is therefore clear that at the time of splitting<\/p>\n<p>up   of   the   property   by   acquisition   in   1963,   there   was<\/p>\n<p>access to the remaining property. Hence right of easement<\/p>\n<p>by   necessity   cannot   be   claimed   through   the   acquired<\/p>\n<p>property. Subsequent splitting up of tenement by execution<\/p>\n<p>of gift deed in 1968 will not enable appellants to claim a<\/p>\n<p>right   of   way     through   the   acquired   property.   As     rightly<\/p>\n<p>found by courts below right of easement by necessity could<\/p>\n<p>be   claimed     only   over   the   eastern   property,   which   was<\/p>\n<p>gifted to Aleyamma in 1968. Appellants are not entitled to<\/p>\n<p><span class=\"hidden_text\">                                     5<\/span><\/p>\n<p>claim a right of easement by necessity over the   acquired<\/p>\n<p>property, which was split up five years prior to splitting<\/p>\n<p>up of tenement in 1968. Appellants are not entitled to get<\/p>\n<p>the right of  easement by necessity  claimed in the suit.\n<\/p>\n<p>       No   substantial   question   of   law   is   involved   in   the<\/p>\n<p>appeal.
