SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioners-original plaintiffs have prayed for an appropriate<br \/>\norder to quash and set aside the impugned orders passed by the<br \/>\nlearned trial Court below Exhs. 10 and 13 dated 28\/03\/2011 in Regular<br \/>\nCivil Suit No. 89\/2011.\n<\/p>\n<p>2.\tThe<br \/>\nfacts leading to the present Special Civil Application in a nutshell<br \/>\nare as under;\n<\/p>\n<p>2.1.\tThe<br \/>\npetitioners-original plaintiffs have instituted Regular Civil Suit<br \/>\nNo. 89\/2011 against the respondents-original defendants in the Court<br \/>\nof learned Civil Judge (Senior Division), Rajkot.  In the said suit<br \/>\nthe petitioners-original plaintiffs submitted an application, Exh. 6<br \/>\nto appoint the Court Commissioner to prepare the panchnama, which<br \/>\ncame to be allowed ex parte by the learned 5th Additional<br \/>\nSenior Civil Judge, Rajkot directing to appoint the Court<br \/>\nCommissioner to prepare the panchnama of the suit property.  It<br \/>\nappears that one another suit was already pending before another<br \/>\nCourt between the same parties with respect to the same property in<br \/>\nwhich application, Exh. 5 was submitted and the learned trial Court<br \/>\ndisposed of the said application, Exh. 5 by directing the parties to<br \/>\nmaintain status-quo and only thereafter the petitioners-original<br \/>\nplaintiffs submitted the application, Exh. 6 and the same was decided<br \/>\nwithout hearing the respondents-original defendants. The<br \/>\nrespondents-original defendants submitted the application, Exh. 10 to<br \/>\nstay the order passed below Exh. 6 dated 23\/03\/2011, which came to be<br \/>\ngranted by the learned trial Court and the order dated 23\/03\/2011 was<br \/>\nstayed, which was further continued.  Being aggrieved and<br \/>\ndissatisfied with the aforesaid order staying the order passed below<br \/>\nExh. 6 dated 23\/03\/2011, the petitioners-original plaintiffs have<br \/>\npreferred the present Special Civil Application under Article 227 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the impugned orders as well as the order<br \/>\npassed by the learned trial Court below Exh. 6 dated 23\/03\/2011, it<br \/>\nappears that  as the order passed below Exh. 6 dated 23\/03\/2011  was<br \/>\nan  ex parte order and without giving any opportunity to the<br \/>\nrespondents-original defendants, this Court suggested that let all<br \/>\nthe orders inclusive of the order passed by the learned trial Court<br \/>\nbelow Exh. 6 dated 23\/03\/2011 be quashed and set aside and the matter<br \/>\nbe remanded to the learned trial Court for deciding the application,<br \/>\nExh. 6 afresh in accordance with law on its own merits and after<br \/>\ngiving an opportunity to all the concerned. With respect to the<br \/>\nabove, there is a broad consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, the order passed by the learned trial Court below<br \/>\nExh. 6 dated 23\/03\/2011 as well as the subsequent orders passed below<br \/>\nExhs. 10 and 13 are hereby quashed and set aside and the matter is<br \/>\nremanded to the learned trial Court for deciding the application,<br \/>\nExh. 6 afresh in accordance with law on its own merits and after<br \/>\ngiving an opportunity to  all the concerned.
