(C)  No.18746 of 2005]<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tChallenge in these appeals is to the consolidated orders<br \/>\npassed by the Division Bench of the Punjab and Haryana High<br \/>\nCourt dismissing the four writ petitions filed by the appellant<br \/>\nNo.1-Punjab State Electricity Board (in short the &#8216;Board&#8217;).  The<br \/>\nrespondent in each case was engaged as Meter Reader on<br \/>\ncontract basis by the appellant-Board.  After disengagement<br \/>\nhe made a claim stating that he had worked for a considerably<br \/>\nlong continuous period, his services have been terminated by<br \/>\nthe Board without following any procedure and without<br \/>\npayment of retrenchment compensation. Claim for<br \/>\nreinstatement with back wages was made. On failure of the<br \/>\nconciliation proceedings, matter was referred by the concerned<br \/>\nState Government to the Presiding Officer, Labour Court,<br \/>\nLudhiana (hereinafter referred to as the &#8216;Labour Court&#8217;) under<br \/>\nSection 10 of the Industrial Disputes Act, 1947 (in short the<br \/>\n&#8216;Act&#8217;).  Stand of the appellant before the Labour Court was that<br \/>\nthe applicant was engaged as private Meter Reader on contract<br \/>\nbasis which was renewed on two occasions and at the expiry of<br \/>\nthe contract period, the services have been dispensed with.  It<br \/>\nwas specifically averred that the applicant concerned had<br \/>\nnever been employed by the Board and was not a workman<br \/>\nunder the provisions of the Act.  During the concerned period<br \/>\na sum of Re.1\/- for reading was paid as per the contract.<br \/>\nThere was neither any monthly salary nor the claimant could<br \/>\nbe treated as a person appointed by the Board.\n<\/p>\n<p>The Labour Court held that the claimant had been<br \/>\nengaged as a Meter Reader and had worked in that capacity<br \/>\nfor a considerably long period, his services have been<br \/>\nterminated without notice or payment of compensation.  It was<br \/>\nconcluded that the claimant had completed service for more<br \/>\nthan 240 days within the preceding twelve months, and he<br \/>\nhad been retrenched without following the procedure provided<br \/>\nunder Section 25-F of the Act, and as such was entitled to be<br \/>\nreinstated.  However, the back wages were restricted to 25%.<br \/>\nThe Board filed writ petitions questioning the award in each<br \/>\ncase.  The claimants also filed writ petitions questioning<br \/>\nquantum of back wages.\n<\/p>\n<p>The High Court referred to a decision of this Court in<br \/>\n<a href=\"\/doc\/1160961\/\">Steel Authority of India Ltd. And Ors. v. National Union<br \/>\nWaterfront Workers and Ors.<\/a> (2001(7) SCC 1) in which it was<br \/>\nheld that the contract was a camouflage by the Board with a<br \/>\nview to avoid the provisions of the Act.  Accordingly, the writ<br \/>\npetitions filed by the appellant &#8211; Board were dismissed by the<br \/>\nimpugned judgment in each case.  The writ petitions filed by<br \/>\nthe respondents were also dismissed on the ground that they<br \/>\nwere not engaged on any fixed salary.\n<\/p>\n<p>\tLearned counsel for the appellants submitted that<br \/>\nwithout any material, the Labour Court held that the contract<br \/>\nwas a camouflage. Absolutely no material was placed on<br \/>\nrecord to justify such a stand and\/or conclusion.  It is not in<br \/>\ndispute that there was a contract providing for payment of<br \/>\nRe.1\/- for each meter reading.  The contract was renewed<br \/>\nmore than once.  Merely because the meter reading work has<br \/>\nnot decreased, that cannot be a basis to hold that there was a<br \/>\ncamouflage adopted.\n<\/p>\n<p>\tLearned counsel for the respondents on the other hand<br \/>\nsubmitted that both the Labour Court and the High Court<br \/>\nhave recorded finding about the camouflage.\n<\/p>\n<p>At the outset, it has to be noted that the decision in Steel<br \/>\nAuthority&#8217;s case (supra) has absolutely no relevance so far as<br \/>\nthe present dispute is concerned. That relates to a case of<br \/>\ncontract labour. Present dispute is not a case of that nature.<br \/>\nOn the contrary, it appears from the materials placed on<br \/>\nrecord that there was an agreement governing engagement.<br \/>\nThe payment was made per meter reading at a fixed rate and<br \/>\nthere was no regular employment ever offered to any of the<br \/>\nrespondents.  The provisions of Section 2(oo)(bb) of the Act<br \/>\nclearly applies to the facts of the present case.\n<\/p>\n<p>Section 2(oo)(bb) reads as follows:\n<\/p>\n<p>&#8220;2(oo) retrenchment means the termination by<br \/>\nthe employer of the service of a workman for<br \/>\nany reason whatsoever, otherwise than as a<br \/>\npunishment inflicted by way of disciplinary<br \/>\naction, but does not include &#8211;\n<\/p>\n<p>(a)..\n<\/p>\n<p>(b).\n<\/p>\n<p>(bb)\ttermination of the service of the workman<br \/>\nas a result of the non-renewal of the contract<br \/>\nof employment between the employer and the<br \/>\nworkman concerned on its expiry or of such<br \/>\ncontract being terminated under a stipulation<br \/>\nin that behalf contained therein; or&#8221;\n<\/p>\n<p>\tThe material on record clearly established that the<br \/>\nengagement of the respondent was for specific period and<br \/>\nconditional.  It appears that on the appointment of regular<br \/>\nmeter readers, the engagement has been dispensed with.  The<br \/>\ncontracts clearly governed the terms of engagement.\n<\/p>\n<p>\tAbove being the position, the orders passed by the<br \/>\nLabour Court and the High Court are clearly untenable and<br \/>\nare quashed.  In two cases the concerned respondents have<br \/>\nbeen engaged again on contractual basis.
