2.      In\u00a0our\u00a0order\u00a0dated\u00a01\u00a0March\u00a02011,\u00a0we\u00a0had\u00a0directed\u00a0the\u00a0CPIO\u00a0not\u00a0only\u00a0to\u00a0<\/p>\n
provide\u00a0the\u00a0desired\u00a0information\u00a0against\u00a0all\u00a0the\u00a0queries\u00a0of\u00a0the\u00a0Appellant\u00a0but\u00a0also\u00a0<\/p>\n
to \u00a0 appear \u00a0 before \u00a0 us \u00a0 along \u00a0 with \u00a0 the \u00a0 officers \u00a0 concerned \u00a0 responsible \u00a0 for \u00a0 not\u00a0<\/p>\n

\n providing\u00a0the\u00a0information\u00a0in\u00a0time\u00a0to\u00a0explain\u00a0the\u00a0reasons.\u00a0Today,\u00a0the\u00a0CPIO\u00a0along\u00a0<\/p>\n
with\u00a0the\u00a0relevant\u00a0officers\u00a0appeared\u00a0before\u00a0us\u00a0during\u00a0the\u00a0hearing.\u00a0The\u00a0Appellant\u00a0<\/p>\n
was\u00a0also\u00a0present.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\n<\/p>\n<\/p>\n
3.      The\u00a0Appellant\u00a0had\u00a0made,\u00a0in\u00a0all,\u00a011\u00a0queries.\u00a0In\u00a0the\u00a0detailed\u00a0reply\u00a0sent\u00a0to\u00a0<\/p>\n
him, \u00a0 the \u00a0 CPIO\u00a0 has \u00a0 observed\u00a0 that \u00a0 the \u00a0 relevant\u00a0 records\u00a0 against\u00a0 most \u00a0 of \u00a0 the\u00a0<\/p>\n
queries\u00a0were\u00a0no\u00a0longer\u00a0available\u00a0and,\u00a0therefore,\u00a0no\u00a0information\u00a0could\u00a0be\u00a0given.\u00a0<\/p>\n
On\u00a0the\u00a0other\u00a0hand,\u00a0the\u00a0Appellant\u00a0pointed\u00a0out\u00a0that\u00a0he\u00a0had\u00a0proof\u00a0with\u00a0him\u00a0of\u00a0<\/p>\n
having\u00a0submitted\u00a0several\u00a0communications\u00a0and\u00a0complaints\u00a0at\u00a0various\u00a0levels\u00a0in\u00a0<\/p>\n
the\u00a0Lok\u00a0Sabha\u00a0secretariat\u00a0and,\u00a0therefore,\u00a0it\u00a0was\u00a0not\u00a0right\u00a0on\u00a0the\u00a0part\u00a0of\u00a0the\u00a0<\/p>\n
CPIO\u00a0or\u00a0others\u00a0to\u00a0claim\u00a0that\u00a0no\u00a0records\u00a0were\u00a0available.\u00a0During\u00a0the\u00a0detailed\u00a0<\/p>\n
hearing\u00a0of\u00a0the\u00a0matter,\u00a0it\u00a0turned\u00a0out\u00a0that\u00a0in\u00a0the\u00a0Lok\u00a0Sabha\u00a0secretariat,\u00a0there\u00a0is\u00a0no\u00a0<\/p>\n
practice\u00a0of\u00a0maintaining\u00a0any\u00a0record\u00a0of\u00a0movement\u00a0of\u00a0communications,\u00a0such\u00a0as,\u00a0<\/p>\n
letters\u00a0 et\u00a0 cetera\u00a0 within\u00a0 the\u00a0secretariat\u00a0 and,\u00a0 therefore,\u00a0it\u00a0was\u00a0 not\u00a0possible\u00a0 to\u00a0<\/p>\n
identify\u00a0exactly\u00a0if\u00a0any\u00a0communication\u00a0as\u00a0claimed\u00a0by\u00a0the\u00a0Appellant\u00a0had\u00a0indeed\u00a0<\/p>\n
been\u00a0received\u00a0in\u00a0the\u00a0relevant\u00a0section\u00a0or\u00a0not.\u00a0However,\u00a0on\u00a0a\u00a0thorough\u00a0scrutiny\u00a0of\u00a0<\/p>\n
the\u00a0queries\u00a0of\u00a0the\u00a0Appellant\u00a0and\u00a0the\u00a0reply\u00a0given\u00a0by\u00a0the\u00a0CPIO\u00a0in\u00a0each\u00a0case,\u00a0we\u00a0<\/p>\n
noted \u00a0 that \u00a0 due \u00a0 diligence \u00a0 had \u00a0 not \u00a0 been \u00a0 made \u00a0 in \u00a0 tracing \u00a0 the \u00a0 relevant\u00a0<\/p>\n
papers\/records\u00a0before\u00a0giving\u00a0a\u00a0summary\u00a0response\u00a0that\u00a0no\u00a0record\u00a0was\u00a0available.<\/p>\n
4.      In\u00a0the\u00a0light\u00a0of\u00a0the\u00a0above,\u00a0we\u00a0would\u00a0like\u00a0to\u00a0direct\u00a0the\u00a0CPIO\u00a0once\u00a0again\u00a0to\u00a0<\/p>\n
search\u00a0 for\u00a0 the\u00a0 relevant\u00a0records\u00a0 in \u00a0the\u00a0sections\u00a0 concerned\u00a0 and,\u00a0if\u00a0 traced,\u00a0 to\u00a0<\/p>\n
provide\u00a0copies\u00a0of\u00a0the\u00a0relevant\u00a0action\u00a0taken\u00a0reports\u00a0and\u00a0other\u00a0documents\u00a0to\u00a0the\u00a0<\/p>\n
Appellant\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0However,\u00a0if\u00a0<\/p>\n
some\u00a0or\u00a0all\u00a0of\u00a0the\u00a0relevant\u00a0records\u00a0are\u00a0not\u00a0traceable\u00a0any\u00a0longer,\u00a0we\u00a0direct\u00a0the\u00a0<\/p>\n
CPIO\u00a0to\u00a0confirm\u00a0this\u00a0to\u00a0the\u00a0Appellant\u00a0in\u00a0a\u00a0sworn\u00a0affidavit\u00a0within\u00a0the\u00a0same\u00a0period.\u00a0<\/p>\n
We\u00a0further\u00a0direct\u00a0the\u00a0CPIO\u00a0to\u00a0state\u00a0in\u00a0the\u00a0said\u00a0affidavit\u00a0if\u00a0the\u00a0relevant\u00a0records\u00a0<\/p>\n

\n had \u00a0 been \u00a0 destroyed \u00a0 in \u00a0 terms\u00a0 of \u00a0 the \u00a0 guidelines\u00a0 followed \u00a0 by \u00a0 the \u00a0 Lok \u00a0 Sabha\u00a0<\/p>\n
secretariat\u00a0for\u00a0retention\u00a0of\u00a0records.\n<\/p>\n<\/p>\n
5.      While\u00a0dealing\u00a0with\u00a0this\u00a0matter,\u00a0we\u00a0were\u00a0rather\u00a0surprised\u00a0to\u00a0know\u00a0that\u00a0the\u00a0<\/p>\n
Lok\u00a0Sabha\u00a0secretariat\u00a0did\u00a0not\u00a0have\u00a0any\u00a0system\u00a0of\u00a0maintaining\u00a0records\u00a0about\u00a0<\/p>\n
the\u00a0receipt\u00a0and\u00a0dispatch\u00a0of\u00a0communications\u00a0including\u00a0files\u00a0among\u00a0its\u00a0various\u00a0<\/p>\n
divisions.\u00a0Unless\u00a0such\u00a0catalogues\u00a0are\u00a0maintained\u00a0to\u00a0keep\u00a0a\u00a0record\u00a0of\u00a0the\u00a0trail\u00a0of\u00a0<\/p>\n
movement\u00a0of\u00a0papers\u00a0in\u00a0the\u00a0office,\u00a0retrieval\u00a0of\u00a0the\u00a0relevant\u00a0records\u00a0when\u00a0sought\u00a0<\/p>\n
under\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act\u00a0would\u00a0become\u00a0extremely\u00a0difficult.\u00a0In\u00a0<\/p>\n
fact,\u00a0section\u00a04\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act\u00a0clearly\u00a0mandates\u00a0that\u00a0the\u00a0<\/p>\n
public\u00a0authority\u00a0should\u00a0maintain\u00a0all\u00a0its\u00a0records\u00a0duly\u00a0catalogued\u00a0and\u00a0indexed\u00a0in\u00a0a\u00a0<\/p>\n
manner\u00a0and\u00a0form\u00a0which\u00a0would\u00a0facilitate\u00a0the\u00a0right\u00a0to\u00a0information.\u00a0In\u00a0this\u00a0age\u00a0of\u00a0<\/p>\n
computerisation,\u00a0maintaining\u00a0such\u00a0catalogues\u00a0to\u00a0keep\u00a0a\u00a0tab\u00a0on\u00a0the\u00a0movement\u00a0<\/p>\n
of\u00a0records\u00a0from\u00a0one\u00a0division\u00a0to\u00a0another\u00a0or\u00a0from\u00a0one\u00a0office\u00a0to\u00a0another\u00a0should\u00a0be\u00a0<\/p>\n
very\u00a0easy.\u00a0We\u00a0would\u00a0like\u00a0the\u00a0CPIO\u00a0to\u00a0place\u00a0this\u00a0order\u00a0before\u00a0the\u00a0Secretary\u00ad<\/p>\n
General\u00a0for\u00a0appropriate\u00a0action\u00a0in\u00a0this\u00a0regard.\n<\/p>\n<\/p>\n
6.      The\u00a0matter\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<\/p>\n
