PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Pradeep Choudhary, for the petitioner.\n<\/p>\n<p>                            &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>       Heard learned counsel for the petitioner.\n<\/p>\n<p>       The petitioner is aggrieved against the order<br \/>\ndated 29.3.2010 by which the respondent no.6 has<br \/>\nbeen selected on the basis of having more marks in<br \/>\ngraduation       than    the      marks       obtained       by    the<br \/>\npetitioner and he has been given appointment on<br \/>\nthe post of Rojgar Sahayak.\n<\/p>\n<p>       Learned    counsel    for       the    petitioner     submits<br \/>\nthat    as      per   the   requirements             prescribed    in<br \/>\nAnnexure-2 dated 20.8.2007, the comparative merit<br \/>\ncould    have    been   considered only          if    the   subject<br \/>\nwould have been Commerce in graduation. It is also<br \/>\nsubmitted that the order impugned has been passed<br \/>\nby     the     authority       who      had     no     jurisdiction<br \/>\nprescribed in Annex.P\/2 dated 20.8.2007.\n<\/p>\n<p>       It is admitted case of the petitioner that the<br \/>\nrespondent no.6 had more marks in graduation than<br \/>\nthe    marks     obtained    by       the    petitioner      and   the<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>petitioner&#8217;s contention that the comparative marks<br \/>\ncould have been considered by the authority only<br \/>\nwhen the subject would have been commerce has no<br \/>\nbasis because of the plain and simple reason that<br \/>\nwhile considering the merits if all other facts<br \/>\nare    similar      than       the        marks     obtained      by     the<br \/>\ncandidates are required to be examined to judge<br \/>\nthe    suitability.           Since       the     petitioner      is     not<br \/>\neligible, therefore, I do not find any reason to<br \/>\ninterfere     in    the    order      dated        29.3.2010      only    on<br \/>\ntechnical grounds and particularly because of the<br \/>\nreason      that    this        Court       in     petitioner&#8217;s        writ<br \/>\npetition no.4642\/2009 directed the respondents to<br \/>\nconsider     the    case      afresh       and     the    authority      who<br \/>\npassed the order on 29.3.2010 is also party in the<br \/>\nwrit     petition       and     connected          with    the     project<br \/>\nwherein appointment was given.\n<\/p>\n<p>       In   view   of     the    above,          this    writ    petition,<br \/>\nhaving no merits, is hereby dismissed.\n<\/p>\n<p>                                                  (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Shrawan Kumar vs State Of Raj. &amp; Ors on 19 April, 2010 1 S.B.
