Justice P.N.RAVINDRAN\n\n Dated :25\/07\/2008\n\n O R D E R\n              J.B.KOSHY &amp; P.N.RAVINDRAN, JJ.\n                    --------------------------------------\n                     W.A.No.1493 OF 2008\n                    -------------------------------------\n                      Dated 25th July, 2008\n\n                             JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>            Appellant\/petitioner is included in the rank list<\/p>\n<p>published by the Public Service Commission for the post of<\/p>\n<p>Lower Division Clerk             in Various Departments in the<\/p>\n<p>Kasaragode District.      His mother belongs to Hindu Paraya<\/p>\n<p>Community and father belongs to Hindu Ganaka Community.<\/p>\n<p>Paraya Community is a Scheduled Caste Community, whereas,<\/p>\n<p>Ganaka Community is an Other Backward Community (OBC).<\/p>\n<p>When his name was short listed, he was asked to produce the<\/p>\n<p>caste certificate. Ext.P7 certificate was issued by the Tahsildar,<\/p>\n<p>the competent authority for issuance of caste certificate,<\/p>\n<p>certifying that the petitioner belongs to Hindu Ganaka<\/p>\n<p>Community (OBC) because as per the guidelines , in the<\/p>\n<p>absence of any other materials, caste of the children should be<\/p>\n<p>determined by the father&#8217;s caste. But, in the school certificate,<\/p>\n<p>and earlier caste certificate, he was treated as belonging to<\/p>\n<p>Paraya Community. According to the petitioner, he was born<\/p>\n<p>and brought up in Paraya Community and he follows the<\/p>\n<p><span class=\"hidden_text\">W.A.1493\/2008                       2<\/span><\/p>\n<p>customs in the Paraya Community. Since his request to the<\/p>\n<p>Collector was unsuccessful, he filed a complaint before the Lok<\/p>\n<p>Ayukta making the     Chief Secretary, Principal Secretary to<\/p>\n<p>Government, District Collector etc. as parties.       Lok Ayukta<\/p>\n<p>considered the matter in detail and found that the petitioner<\/p>\n<p>was born and brought up in Paraya Community and be belongs<\/p>\n<p>to Hindu Paraya (Scheduled Caste) Community.              A very<\/p>\n<p>detailed order, considering all the contentions and legal points,<\/p>\n<p>was passed by the Lok Ayukta. Accordingly, fifth respondent<\/p>\n<p>was directed to issue the caste certificate in respect of the<\/p>\n<p>petitioner as `Hindu Paraya Community&#8217;. The above decision<\/p>\n<p>is not challenged. In fact, it is implemented. Tahsildar issued<\/p>\n<p>Ext.P10 dated 29\/12\/2007 saying that the petitioner belongs to<\/p>\n<p>Hindu-Paraya Community. It was produced before the Public<\/p>\n<p>Service Commission.     But, the PSC declined to receive it.<\/p>\n<p>Hence, the writ petition was filed. The rank list is in force now<\/p>\n<p>also and the new list is not yet published.      Petitioner was<\/p>\n<p>entitled to be considered and to be included in the rank list in<\/p>\n<p>the turn of Hindu Paraya Community (S.C).           Accordingly,<\/p>\n<p>Ext.P10 certificate is direced to be accepted by the PSC and<\/p>\n<p>when turn comes, before the expiry of the rank list, he should<\/p>\n<p>be advised. But, since other advised candidates are not made<\/p>\n<p><span class=\"hidden_text\">W.A.1493\/2008                      3<\/span><\/p>\n<p>parties, all those candidates who were already advised will not<\/p>\n<p>lose their seniority.
