DAVE\n\t\t\n\t\n\n \n\nDate\n: 11\/05\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThis petition is directed<br \/>\nagainst the order of detention dated 28.03.2011 passed by respondent<br \/>\nNo.2, in exercise of powers conferred under Section 3(1)\/3(2) of the<br \/>\nGujarat Prevention of Anti Social Activities Act, 1985 (in short &#8220;the<br \/>\nAct&#8221;) by detaining the detenue as a &#8220;bootlegger&#8221; as<br \/>\ndefined under Section 2(b) of the Act.\n<\/p>\n<p>2.\t\tLearned Advocate for the<br \/>\ndetenue submits that registration of FIR\/s itself cannot lead to<br \/>\ndisturbance of even tempo of public life and therefore the public<br \/>\norder.  It is, further, submitted that, except FIR\/s registered under<br \/>\nthe Bombay Prohibition Act, there was no other material before the<br \/>\ndetaining authority, whereby it could be inferred reasonably that the<br \/>\ndetenue is a &#8216;bootlegger&#8217; within the meaning of Section 2(b) of the<br \/>\nAct and required to be detained as the detenue&#8217;s activities are<br \/>\nprejudicial to the maintenance of public health and public order. In<br \/>\nsupport of the above submission, learned Counsel for the detenue has<br \/>\nplaced reliance on judgment of the Apex Court in the case of &#8220;<a href=\"\/doc\/1169973\/\">Piyush<br \/>\nKantilal Mehta vs. Commissioner of Police<\/a>&#8220;, AIR 1989 SC<br \/>\n491, and the recent judgment, dated 28.03.2011, passed by the<br \/>\nDivision Bench of this Court (Coram : S.K. Mukhopadhaya C.J. and J.B.<br \/>\nPardiwala, J.) in Letters Patent Appeal No.2732 of 2010 in<br \/>\nSpecial Civil Application No.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner<br \/>\nof Police)<\/a> which would squarely help the detenue.\n<\/p>\n<p>3.\t\tLearned Assistant Government<br \/>\nPleader submitted that registration of FIR\/s would go to show that<br \/>\nthe detenue had, in fact, indulged into such activities, which can be<br \/>\nsaid to be disturbing the public health and public order and in view<br \/>\nof sufficient material before the detaining authority to pass the<br \/>\norder of detention, no interference is called for by this Court in<br \/>\nexercise of powers under Article 226 of the Constitution of India.\n<\/p>\n<p>4.\t\tHaving heard the rival<br \/>\nsubmissions of the parties and having perused the record of the case,<br \/>\nI am of the view that FIR\/s registered under the Bombay Prohibition<br \/>\nAct alone cannot be said to be sufficient enough to arrive at a<br \/>\nsubjective satisfaction to the effect that the activities, as<br \/>\nalleged, are prejudicial to the public order or lead to disturbance<br \/>\nof public order.  There has to be nexus and link for such activities<br \/>\nwith disturbance of the public order.  On careful perusal of the<br \/>\nmaterial available on record and the ratio laid down by the Apex<br \/>\nCourt in the case of  &#8220;Piyush Kantilal Mehta&#8221;\n<\/p>\n<p>(supra) and the recent judgment dated 28.03.2011 passed by the<br \/>\nDivision Bench of this Court (Coram : S.K. Mukhopadhaya C.J. and J.B.<br \/>\nPardiwala, J.) in Letters Patent Appeal No.2732 of 2010 in<br \/>\nSpecial Civil Application No.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner<br \/>\nof Police), I<\/a> am of the view that the activities of the<br \/>\ndetenue cannot be said to be in any manner prejudicial to the public<br \/>\norder and therefore, the order of detention passed by the detaining<br \/>\nauthority cannot be sustained and is required to be quashed and set<br \/>\naside.\n<\/p>\n<p>5.\t\tIn the result, the petition<br \/>\nis allowed.  The order of detention dated 28.03.2011 is quashed and<br \/>\nset aside.  The detenue, is ordered to be set at liberty forthwith,<br \/>\nif not required in connection with any other case.
