Justice M.SASIDHARAN NAMBIAR\n\n Dated :09\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n                W.P.C.NO.21832 OF 2006\n              ------------------------------------------\n\n              Dated     9th September             2009\n\n\n                          JUDGMENT\n<\/pre>\n<p>          Petitioner is the accused in C.P.34\/2006 on<\/p>\n<p>the  file  of   Judicial          First       Class      Magistrate-I,<\/p>\n<p>Pathanamthitta taken cognizance for the offence under<\/p>\n<p>Sections 498 A, 304(B) and 306 of Indian Penal Code on<\/p>\n<p>Ext.P3 final report. This petition is filed under<\/p>\n<p>Article 226 of Constitution of India for a writ of<\/p>\n<p>mandamus to conduct a further investigation after<\/p>\n<p>quashing  Ext.P2    order        passed        by     Chief   Judicial<\/p>\n<p>Magistrate,  Pathanamthitta           on     18\/1\/2005      permitting<\/p>\n<p>re-investigation of the case under Section 173(8) of<\/p>\n<p>Code of Criminal Procedure. Petitioner would contend<\/p>\n<p>that   the case was originally registered                        under<\/p>\n<p>Section  174  of     Code      of      Criminal         Procedure and<\/p>\n<p>thereafter case was investigated for the offence under<\/p>\n<p>Section 498 A of Indian Penal Code and final report<\/p>\n<p>dated 30\/8\/2004 was submitted alleging that petitioner<\/p>\n<p>committed an offence under Section 498 A                   which  was<\/p>\n<p>taken cognizance as C.C.272\/2004. Thereafter, as per<\/p>\n<p>WPC 21832\/06<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>order   dated  6\/1\/2005,  case   was  transferred   to<\/p>\n<p>C.B.C.I.D for investigation and   later permission was<\/p>\n<p>sought for from Chief Judicial Magistrate for re-<\/p>\n<p>investigation which was granted as per Ext.P2 order.<\/p>\n<p>It is contended that    learned Magistrate could not<\/p>\n<p>have  directed a re-investigation under Section 173(8)<\/p>\n<p>and at best, only a further investigation is possible<\/p>\n<p>and therefore,   Ext.P2 order is illegal and is to be<\/p>\n<p>quashed.\n<\/p>\n<p>           2.  It is contended that after conducting a<\/p>\n<p>re-investigation Ext.P3 final report was filed and<\/p>\n<p>that too after originally filing a report        dated<\/p>\n<p>10\/2\/2005 to the effect that offence under Section 306<\/p>\n<p>of Indian Penal code was committed and on 23\/4\/2005<\/p>\n<p>alleging that   offence under Section 304(B) was also<\/p>\n<p>committed    and finally as per    final report dated<\/p>\n<p>10\/7\/2006 it is alleged that petitioner      committed<\/p>\n<p>offence under Sections 498 A, 304(B) and 306 of Indian<\/p>\n<p>Penal Code. It is contended that as there is no power<\/p>\n<p>for re-investigation and Ext.P3 report submitted after<\/p>\n<p>re-investigation is to be quashed as  not sustainable.<\/p>\n<p>It is also contended that Ext.P3 report is filed<\/p>\n<p>under  haste,    as  is  clear  from  the  conduct  of<\/p>\n<p>WPC 21832\/06<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>investigation and as per the   records, close relatives<\/p>\n<p>of  the   petitioner including       mother  had  given<\/p>\n<p>statements against the petitioner which can   never be<\/p>\n<p>true  and    those  statements  were  manipulated   and<\/p>\n<p>concocted and in such circumstances, an independent<\/p>\n<p>further investigation is essential.<\/p>\n<p>           3.  Learned counsel appearing for petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>           4.  Learned counsel pointed out that Ext.P2<\/p>\n<p>order shows that    permission   was   granted      for<\/p>\n<p>re-investigation and not for     further investigation<\/p>\n<p>and under Section 173(8) of Code of Criminal Procedure<\/p>\n<p>no re-investigation   can be ordered or conducted and<\/p>\n<p>therefore,   Ext.P2 order     and  further  proceedings<\/p>\n<p>initiated   thereunder  is  illegal.  Learned   counsel<\/p>\n<p>relied on the decision of the Apex court in        Rama<\/p>\n<p>Chaudhary   v. State of Bihar (2009 (6) SCC 346) and<\/p>\n<p>argued that there is an ocean of difference     between<\/p>\n<p>re-investigation   and further investigation and     by<\/p>\n<p>ordering re-investigation learned Magistrate is not<\/p>\n<p>entitled to wipe out the earlier   investigation and at<\/p>\n<p>best, only a further investigation could be conducted.<\/p>\n<p>It is also argued that as investigation conducted<\/p>\n<p>WPC 21832\/06<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>subsequent to Ext.P2 is not a further investigation<\/p>\n<p>and in the light of the final report later submitted,<\/p>\n<p>a proper independent investigation is warranted.<\/p>\n<p>           5. Learned Public Prosecutor submitted that<\/p>\n<p>though learned Magistrate has used the      word   re-<\/p>\n<p>investigation by mistake, what is provided       under<\/p>\n<p>Section 173(8)  is only further investigation and what<\/p>\n<p>is  permitted  under  Section  173(8)  could  also  be<\/p>\n<p>further investigation and   for the mistake in using<\/p>\n<p>the word re-investigation, Ext.P2 need not be quashed<\/p>\n<p>and there is no circumstance warranting a further<\/p>\n<p>independent investigation as sought for.<\/p>\n<p>           6. Section 173(8)     of Code of Criminal<\/p>\n<p>Procedure   enables  the   investigating   officer  to<\/p>\n<p>investigate the case  further. Re-investigation is not<\/p>\n<p>contemplated under the Code. Section 173(8) enables<\/p>\n<p>the investigating officer, subsequent to the filing of<\/p>\n<p>final report under sub section 2 of Section 173, to<\/p>\n<p>investigate the case further. Though sub section 8<\/p>\n<p>does not provide  for obtaining previous permission of<\/p>\n<p>the Magistrate, as held in   various decisions  of the<\/p>\n<p>Apex court, when the Magistrate has already seized  of<\/p>\n<p>the matter, before conducting a further investigation,<\/p>\n<p>WPC 21832\/06<br \/>\n<span class=\"hidden_text\">                             5<\/span><\/p>\n<p>a  formal   permission  is  to  be     sought  by   the<\/p>\n<p>investigating officer.   What was granted under Ext.P2<\/p>\n<p>is only a permission for   further investigation under<\/p>\n<p>Section 173(8), though the word wrongly used       was<\/p>\n<p>re-investigation. Therefore, for that mistake, Ext.P2<\/p>\n<p>cannot be quashed. It is clear from Ext.P3 report that<\/p>\n<p>what was conducted by the investigating    officer   is<\/p>\n<p>not  re-investigation but only further investigation.<\/p>\n<p>Therefore, on that ground neither Ext.P2 nor Ext.P3<\/p>\n<p>are liable to be quashed.\n<\/p>\n<p>           7.  Though learned counsel vehemently argued<\/p>\n<p>that further investigation conducted was not proper<\/p>\n<p>and     statements  of  the  close  relatives  of  the<\/p>\n<p>petitioner   including   the   mother   were   recorded<\/p>\n<p>incorrectly and those statements were not made by the<\/p>\n<p>respective   witnesses,  I   cannot  agree   with   the<\/p>\n<p>submission   that  on   that   allegation   a   further<\/p>\n<p>investigation  is  warranted.  If,  the  case  of   the<\/p>\n<p>petitioner is true, at the time of examination the<\/p>\n<p>said witnesses will not support the version    seen in<\/p>\n<p>the statements recorded under Section 161 of Code of<\/p>\n<p>Criminal Procedure, in which case petitioner need not<\/p>\n<p>have any apprehension. In any case, as the     previous<\/p>\n<p>WPC 21832\/06<br \/>\n<span class=\"hidden_text\">                              6<\/span><\/p>\n<p>statements recorded under Section 161    are available,<\/p>\n<p>petitioner is definitely     entitled to use them    to<\/p>\n<p>confront   to the witness in case witnesses are giving<\/p>\n<p>a  version   different   from  the  statements  already<\/p>\n<p>recorded. In such circumstances, on the ground that<\/p>\n<p>statements which are recorded by the investigating<\/p>\n<p>officer subsequent to Ext.P2 order are not correct<\/p>\n<p>no further investigation is not warranted.
