(J)\n\nCITATION:\n JT 1996 (7)   657\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\tTHE 27TH DAY OF AUGUST, 1996<br \/>\nPresent:\n<\/p>\n<blockquote><p>\t  Hon&#8217;ble Mr.Justice K.Ramaswamy<br \/>\n\t  Hon&#8217;ble Mr.Justice B.L.Hansaria<br \/>\n\t  Hon&#8217;ble Mr.Justice S.B.Majmudar<br \/>\nB.D.Agarwal, Sr.  Adv. and Vinay Garg, Adv. with him for the<br \/>\nPetitioner<br \/>\n\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered:\n<\/p><\/blockquote>\n<p><a href=\"\/doc\/284829\/\"><\/p>\n<p>Rameshwar Dass Gupta<br \/>\nV.\n<\/p>\n<p>State of U.P &amp; Anr.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     This<\/p>\n<p><\/a>   special leave  petition arises from the order of<br \/>\nthe learned single Judge of the Allahabad High Court made in<br \/>\nCivil Revision\tNo. 541\/96  on April  24, 1996. The admitted<br \/>\nposition is that the order of removal of the petitioner from<br \/>\nservice was  set aside by the U.P. Public Services Tribunal,<br \/>\nLucknow. The Tribunal directed as under :<\/p>\n<blockquote><p>     &#8220;The petition  is\tpartly\tallowed.<br \/>\n     The O.P.  No. 1  and 2 are directed<br \/>\n     to consider the confirmation of the<br \/>\n     petitioner\t on  Group  1  post  and<br \/>\n     consequent promotion  to  Class  II<br \/>\n     and Class\tI post\tfrom the date on<br \/>\n     which his\tjunior Sri Ram Niwas was<br \/>\n     promoted  to  such\t post  with  all<br \/>\n     consequential\tbenefits      of<br \/>\n     seniority,\t salary,  pension  etc.,<br \/>\n     arising therefrom.&#8221;<\/p><\/blockquote>\n<p>     In execution  thereof, as per the rules, the petitioner<br \/>\nlaid execution petition under Order 21 Rule 1, CPC read with<br \/>\nclause [5]  of the  Tribunal&#8217;s Rules,  On a  certificate for<br \/>\nrecovery of the dues under the order. The executing court in<br \/>\nthe impugned  order dated  December 12, 1995, in addition to<br \/>\nthe  salary,   gratuity\t and  pension  in  a  total  sum  of<br \/>\nRs.1,97,575.32, awarded\t interest at  124 per annum from the<br \/>\ndate of\t the execution\ttill date  of the order which worked<br \/>\nout to\tthe sum of Rs.1,46,205\/-. The respondents challenged<br \/>\nthe legality thereof only in respect of the direction to pay<br \/>\nthe interest  at 12%. In the revision, the High Court in the<br \/>\nimpugned order held that the executing Court had no power to<br \/>\nenlarge the  decree. The  decree of  the Tribunal  does\t not<br \/>\ngrant  payment\t of  interest\tand,  Wherefore,  the  order<br \/>\ndirecting payment of interest was without jurisdiction. Thus<br \/>\nthis special leave petition.\n<\/p>\n<p>     It is contended for the petitioner that though normally<br \/>\nthe executing  Court cannot  grant interest,  in view of the<br \/>\nunreasonable stand  taken by the judgment-debtors in denying<br \/>\nthe legitimate\tclaims of  the petitioner and for prolonging<br \/>\nthe case  unreasonably for  long time,\tthe executing  Court<br \/>\nmust be\t held to  have jurisdiction  to\t grant\tinterest  in<br \/>\nexecution  of\tthe  decree.  He  also\tcontended  that\t the<br \/>\nrevisional power  of the  High Court should be confined only<br \/>\nto errors  which do  vitiate the  ultimate justice.  In this<br \/>\ncase, the  executing Court,  having regard  to the facts and<br \/>\ncircumstances  of   the\t case,\t has  done  justice  to\t the<br \/>\npetitioner. The\t High Court,  therefore, was  not  right  in<br \/>\nreversing the  order.  We  find\t no  force  in\tany  of\t his<br \/>\ncontentions.\n<\/p>\n<p>     It is  well settled  legal position  that an  executing<br \/>\nCourt  cannot  travel  beyond  the  order  or  decree  under<br \/>\nexecution, It gets jurisdiction only to execute the order in<br \/>\naccordance with the procedure laid down under Order 21, CPC.<br \/>\nIn view of the fact that it is a money claim, what was to be<br \/>\ncomputed is  the arrears of the salary, gratuity and pension<br \/>\nafter computation  of his promotional benefits in accordance<br \/>\nwith the  service law.\tThat having  been done and the court<br \/>\nhaving decided the entitlement of the decree-holder in a sum<br \/>\nof Rs.1,97,000\/-  and  odd,  the  question  that  arises  is<br \/>\nwhether the  executing Court  could step  out  and  grant  a<br \/>\ndecree for  interest which  was not  part of  the decree for<br \/>\nexecution  on\tthe  ground  of\t delay\tin  payment  or\t for<br \/>\nunreasonable stand  taken in  execution ?  In our  view, the<br \/>\nexecuting Court\t has exceeded its jurisdiction and the order<br \/>\nis one\twithout jurisdiction and is thereby a void order. It<br \/>\ntrue that  the High  Court normally exercises its revisional<br \/>\njurisdiction under Section 115, CPC but once it is held that<br \/>\nthe executing Court has exceeded its jurisdiction, it is but<br \/>\nthe duty  of the  High Court to correct the same. Therefore,<br \/>\nwe do not find any illegally in the order passed by the High<br \/>\nCourt in  interfering  with  and  setting  aside  the  order<br \/>\ndirecting payment of interest.\n<\/p>\n<p>     The special  leave petition  is accordingly  dismissed.<br \/>\nWhatever be  the difference of amount due and payable to the<br \/>\npetitioner, it is but the duty of the respondents to pay the<br \/>\nsame as\t expeditiously as  possible but not later than three<br \/>\nmonths from  the date  of the  receipt of  this\t order.\t The<br \/>\npetitioner is  directed to  communicate this  order  to\t the<br \/>\nrespondents.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Rameshwar Dass Gupta vs State Of U.P &amp; Anr on 27 August, 1996 Equivalent citations: JT 1996 (7) 657 Author: K Ramaswamy Bench: Ramaswamy, K.
