JUSTICE SUSHIL HARKAULI\n                                         ------\n                For the Petitioner:      Mr. Krishna Murari\n                For the Respondents:     Mr. Ananda Sen\n                                         ------\n02\/28.10.2009<\/pre>\n<p>            The petitioner has approached this court in the discretionary<br \/>\n                and equitable writ jurisdiction for rectification of his Date of Birth<br \/>\n                from 1.10.1950 to 10.8.1955. This writ petition has been filed in<br \/>\n                the year 2009 when the petitioner is approaching his age of<br \/>\n                superannuation. The foundation of his claim is a matriculation<br \/>\n                certificate in which the petitioner&#8217;s Date of Birth is mentioned as<br \/>\n                10.8.1955. The petitioner has placed reliance upon a Full Bench<br \/>\n                decision of this Court in the case of &#8216;Kamta Pandey-Vs- BCCL &amp;<br \/>\n                Ors. reported in 2007 (3) JCR 681&#8217;.\n<\/p>\n<p>                         The said decision emphasises the relevance of the Date of<br \/>\n                Birth recorded in the matriculation certificate, but on the facts of<br \/>\n                the present case, I do not find that decision to be applicable<br \/>\n                because admittedly the petitioner was employed in the Central Coal<br \/>\n                Fields Limited which is a Government undertaking on 17.8.1972. If<br \/>\n                the Date of Birth espoused by the petitioner is accepted to be<br \/>\n                correct then on the date of appointment the petitioner would have<br \/>\n                been less than 18 years of age.\n<\/p>\n<p>                         It appears to be quite apparent that the petitioner in order<br \/>\n                to get that employment at that time misrepresented his Date of<br \/>\n                Birth as 1.10.1950 which was accordingly recorded in the service<br \/>\n                record    and    the employment       was   granted. After obtaining<br \/>\n                employment and serving for some time, the petitioner moved for<br \/>\n                rectification of the Date of Birth on the basis of matriculation<br \/>\n                certificate which though obtained earlier but was filed later,<br \/>\n                meaning thereby which was withheld, for obvious reason, at the<br \/>\n                time of obtaining employment. The petitioner&#8217;s contention that the<br \/>\n                matriculation certificate was obtained later is an eye wash. Marks<br \/>\n                sheets are supplied immediately after matriculation result and<br \/>\n                marks sheet also contain the Date of Birth. Therefore, this excuse<br \/>\n                of obtaining matriculation certificate later is just to cover-up the<br \/>\n<span class=\"hidden_text\">                                         2.<\/span><br \/>\n            earlier misconduct of the petitioner in giving wrong Date of Birth<br \/>\n            for the purpose of obtaining employment before he became eligible<br \/>\n            age-wise.\n<\/p>\n<p>                   Considering the fact that the petitioner is under the<br \/>\n            discretionary jurisdiction of this Court, it would not be appropriate<br \/>\n            to allow him to have an advantage at both ends, first at the time of<br \/>\n            obtaining employment and thereafter getting superannuation<br \/>\n            extension.\n<\/p>\n<p>                   The learned counsel for the petitioner has relied upon an<br \/>\n            unreported decision of a learned Single Judge of this Court dated<br \/>\n            10.7.2009 pronounced on 31.7.2009 in W.P.(S) 4181 of 2008 in<br \/>\n            paragraph 18 of which the aspect of initial appointment at an age<br \/>\n            less than 18 years was examined. The facts of that decision were<br \/>\n            that the establishment where the employment took place was<br \/>\n            under a private management and therefore, the strict age of 18<br \/>\n            years for getting employment was not found necessarily to be<br \/>\n            applicable. In the present case, it has not been shown that on the<br \/>\n            date when the petitioner obtained employment in the Central Coal<br \/>\n            Fields Limited i.e. 17.8.1972, the Central Coal Fields Limited was<br \/>\n            under any private management which could have permitted<br \/>\n            employment of a person who was less than 18 years of age.<br \/>\n            Therefore, the decision of the learned Single Judge also is quite<br \/>\n            distinguishable.\n<\/p>\n<p>                   Considering the circumstances, I am not inclined to exercise<br \/>\n            my discretionary jurisdiction in favour of the petitioner on the facts<br \/>\n            of this case.\n<\/p>\n<p>                   This writ petition is dismissed.\n<\/p>\n<p>                                                             (Sushil Harkauli, J.)<br \/>\nSudhir\/FA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Uma Shankar Singh vs Central Coalfields Limited &amp; O on 28 October, 2009 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.
