Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/05\/2010\n\n O R D E R\n              THOTTATHIL B.RADHAKRISHNAN,J.\n                  -------------------------------------------\n                     W.P(C).No.1498 OF 2009\n                  -------------------------------------------\n              Dated this the 24th day of May, 2010\n\n\n                              JUDGMENT\n<\/pre>\n<p>1.The first respondent was an employee of the Catholic Syrian<\/p>\n<p>  Bank which is a scheduled bank.                    She faced disciplinary<\/p>\n<p>  proceedings on different grounds.                    Ultimately, she was<\/p>\n<p>  removed    from    service.           Being       an     employee in  the<\/p>\n<p>  administration of the supervisory cadre of a scheduled bank,<\/p>\n<p>  she could not have invoked the jurisdiction of the labour court,<\/p>\n<p>  she not being a workman or even in a writ petition under<\/p>\n<p>  Article 226 of the Constitution of India in view of the decision<\/p>\n<p>  in <a href=\"\/doc\/123551693\/\">Federal Bank Ltd. v. Sagar Thomas<\/a> [2003 (3) KLT 876].<\/p>\n<p>  But, she could have sued the bank challenging the decision<\/p>\n<p>  before the competent civil court<\/p>\n<p>2.The first respondent, without seeking remedy as noticed<\/p>\n<p>  above, moved the Kerala Women&#8217;s Commission constituted<\/p>\n<p>  under the provisions of the Kerala Women&#8217;s Commission Act<\/p>\n<p>WPC.1498\/09.\n<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>  and sought relief. The Commission, going by its order Ext.P3,<\/p>\n<p>  virtually sat as if it is making a judicial review of the decision<\/p>\n<p>  of the bank. The alleged occurrences or otherwise, and the<\/p>\n<p>  sustainability of the findings in the disciplinary proceedings,<\/p>\n<p>  including enquiry, have been enquired into by the Commission.<\/p>\n<p>  The allegation against the delinquent first respondent were in<\/p>\n<p>  the realm of financial improprieties, though her learned<\/p>\n<p>  counsel says that they were not of huge magnitude. Whatever<\/p>\n<p>  that be, there is no attribute against her by the management<\/p>\n<p>  which would tend to suggest that the fact that the respondent<\/p>\n<p>  is a lady had anything to do at all, either as regards the<\/p>\n<p>  charges or regarding the findings.\n<\/p>\n<\/p>\n<p>3.However, taking the view that the disciplinary proceedings are<\/p>\n<p>  vitiated and bad, the Commission says that the first respondent<\/p>\n<p>  was the only lady Chief Manager in the service of the Catholic<\/p>\n<p>  Syrian Bank and therefore, it appears that the Commission<\/p>\n<p>  took the view that the bank imposed the punishment of<\/p>\n<p>WPC.1498\/09.\n<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p> dismissal from service simply on the reason that she seems to<\/p>\n<p> be a lady.    Arbitrariness, perversity and other grounds on<\/p>\n<p> which this finding of the Commission is attacked necessarily<\/p>\n<p> stands. Equally, the finding of the Commission that the orders<\/p>\n<p> of dismissal is clear discrimination on the ground of sex on the<\/p>\n<p> basis of Article 15 of the Constitution is totally misconceived.<\/p>\n<p> The Commission was totally without authority to say that the<\/p>\n<p> first respondent was an asset to the Catholic Syrian Bank for<\/p>\n<p> about 30 years. The jurisdiction of the Commission in terms of<\/p>\n<p> the Act and the sweep of its powers or need for its institutional<\/p>\n<p> existence would not take within their sweep, matters which<\/p>\n<p> are purely in the realm of service discipline, labour matters<\/p>\n<p> etc, unless of course, in cases where the women employee<\/p>\n<p> faced situation of unfair practice referable to a ground of sex.<\/p>\n<p> The conclusion of the Commission that the dismissal of the<\/p>\n<p> first respondent from service of the bank is an unfair practice<\/p>\n<p> against her on the ground of sex is wholly unfounded,<\/p>\n<p> unsustainable and is hence liable to be quashed.<\/p>\n<p>WPC.1498\/09.\n<\/p>\n<p><span class=\"hidden_text\">                                4<\/span><\/p>\n<p>4.Faced with the aforesaid situation, learned counsel for the first<\/p>\n<p>  respondent stated that the Commission had only requested the<\/p>\n<p>  Board of Directors of the bank to reinstate the employee after<\/p>\n<p>  setting aside the decision of the intra-institutional appellate<\/p>\n<p>  authority.   But, a reading of the last paragraph of the<\/p>\n<p>  impugned Ext.P3 would show that though the word &#8216;request&#8217; is<\/p>\n<p>  used, the immediate supporting reason in the same sentence is<\/p>\n<p>  that the said request is being made as all the charges levelled<\/p>\n<p>  against the officer are baseless and are wrong and without any<\/p>\n<p>  bonafides.\n<\/p>\n<p>  Having found that the impugned action is wholly without<\/p>\n<p>  jurisdiction, Ext.P3 is quashed, however, clarifying that this<\/p>\n<p>  judgment will not stand in the way of the first respondent<\/p>\n<p>  seeking any relief from the bank in relation to the action taken<\/p>\n<p>  against her.     Obviously, neither this judgment nor the<\/p>\n<p>  impugned decision of the Commission would stand in the way<\/p>\n<p>WPC.1498\/09.\n<\/p>\n<p><span class=\"hidden_text\">                              5<\/span><\/p>\n<p> of the bank considering any request of the first respondent as<\/p>\n<p> the case may be.
