Justice M.C.HARI RANI\n\n Dated :02\/12\/2010\n\n O R D E R\n            K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                      W.P.C.No.35745 of 2010\n                    ----------------------------------------\n            Dated this the 2nd day of December 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>K.M.JOSEPH,J<\/p>\n<p>      The petitioner has approached this Court complaining of<\/p>\n<p>harassment by the 4th respondent, Sub Inspector of Police. The<\/p>\n<p>prayer is not to harass the petitioner or to implicate the<\/p>\n<p>petitioner in false case. According to the petitioner, his nephew<\/p>\n<p>has been implicated in a false case. It is also stated that his<\/p>\n<p>nephew was physically tortured by the police. The father and<\/p>\n<p>mother of his nephew filed Ext.P1 complaint before the 1st<\/p>\n<p>respondent. Infuriated by the said complaint, the 4th respondent<\/p>\n<p>is forcing the petitioner to withdraw the complaint and<\/p>\n<p>threatened that otherwise, the petitioner will be implicated in a<\/p>\n<p>crime alleging attempt to murder one Musthaffa, the local<\/p>\n<p>C.P.I.leader, who is said to be a close associate of the 4th<\/p>\n<p>respondent and is grateful to the 4th respondent for the arrest of<\/p>\n<p>the accused in crime No.1620\/2010 described above.<\/p>\n<p>      2.   The learned Government Pleader, on instructions,<\/p>\n<p>submits that the nephew of the petitioner is the 4th accused in<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.35745 of 2010           2<\/span><\/p>\n<p>crime No.1620\/2010 registered under Sections 143, 147, 148,<\/p>\n<p>323, 324, 506(ii), 149 I.P.C and Section 27 of the Arms Act. He<\/p>\n<p>was arrested and enlarged on bail. The father and mother of the<\/p>\n<p>nephew have filed a complaint before the Inspector General and<\/p>\n<p>the Deputy Superintendent of Police, DCRG, Kollam is enquiring<\/p>\n<p>into the matter. The allegation is that the 4th respondent is<\/p>\n<p>compelling the petitioner to withdraw the complaint.         The<\/p>\n<p>learned Government Pleader would submit that the allegations<\/p>\n<p>raised that the petitioner is forced to withdraw the complaint is<\/p>\n<p>not correct. The complaint is filed by one Abdul Rehim and<\/p>\n<p>Jamin. It is submitted that there will be no harassment on the<\/p>\n<p>petitioner in the matter by the 4th respondent.<\/p>\n<p>      3.
