1. This Writ appeal is am against the judg\u00a7\u00a7e:\u00a7i.’.1*;d;\u00e9.:eri’ <\/p>\n
14.09.2006 in Writ Petition No. 46799, __of 2ee3’1′.3yh$ch”..wa$”” V<\/p>\n
dismissed by the learned Single Judge. g’i’h.e  <\/p>\n
petitioner in the writ petition.\n<\/p>\n
2. The appe\ufb01ant was  \u00a7.:As\u00a7”  Engineer in the
\nK.I’-‘.’1’.C.L. on compags.-sionate”_  As per
\nA11nexu.re–A order    that the<\/p>\n
appellant    the probation on
\n06.09.1996.   the year 1999 the appellant
\nrequested 1. for   Assistant Engineer and it was
\n  the ‘reepettdeiitdvvide Annexume-C endorsement dated<\/p>\n
}.5.’G2.’i\u00a799.  stated in Annexure-C is that the appellant<\/p>\n
 7was neat  ‘eppointment as Assistant Engineer as per the<\/p>\n
\u00bb Reen\ufb01iment  Promotion Rules which were in force during his<\/p>\n
 period’ . The appellant made further representation in<\/p>\n
V” smdzttter, but the request was turned down vide Annexure-B<\/p>\n
  .etidorsement dated 06.1 1.2001. Acxxyxding to Annexure-D only a<\/p>\n
person who has completed seven years as Junior Engneer is<\/p>\n
eligible to be promoted to the post of Assistant Engineer<\/p>\n
respondent was not inclined to relax the rules to  <\/p>\n
the appe\ufb02ant and other similarly  _pers_o’n’s?.’ Cf   <\/p>\n
thereafter the appe\ufb02ant \ufb01led Writ  e.”.jF;).  i <\/p>\n
praying for a direction to the zesponadezlt iof *<\/p>\n
transfer as Assistant Engneer. The    petition
\nwas that aeooniing to   Gated 26.07.1986 a
\nJunior Engineer who    could<\/p>\n
be appointed by      Engineer and that<\/p>\n
since the  Quali\ufb01cation and since there
\nwere  iiefetiihiesistant Engineer, he ought to
\niiaire been  to the cadre of Assistant Engneer.
\n  that the requirement of minimum service<\/p>\n
of seven-i’_  Engineer was intmduced only as per<\/p>\n
 Qrdwdatcd 30.11.1995. According to the petitioner<\/p>\n
 H  were wracai ncies in existence dunn’ g the penod’ from<\/p>\n
  (the date of satisfactory completion of probation) and<\/p>\n
 and hence the pe\ufb01tioner could have been promoted to<\/p>\n
  cadre of Assistant Engineer against one of the available<\/p>\n
vaca\ufb01cies. However, the learned Single Judge did not accept the<\/p>\n
contention of the petitioner and dismissed the writ petition.” V  <\/p>\n

\nthe respondent in the _  we have made<\/p>\n
earnest eiforts to     anxiety to ensure<\/p>\n
that no izljus\ufb01zioe is  t9″‘aIl5P\u20ac}1ant.<\/p>\n

   1996 a Junior Engineer who possessed B.E.<\/p>\n
 or    could be appointed by transfer in the<\/p>\n
 eadre of Engineer without insisting on any minimum<\/p>\n
   The requirement of minimum service of seven<\/p>\n
   introduced for the first time as per Am1exure~–B order<\/p>\n
VT 30.11.1996. The ciaim of the appellant for appointment to<\/p>\n
the cadre of Assistant Engnecr was in respect of the <\/p>\n
to 30.11.1996.\n<\/p>\n
5. It cannot be disputed that the appe\ufb01ante VV 2<\/p>\n
appointed by transfer in the cadre of Aseigt\u00e9rit’ :he_<\/p>\n
completed the period of pmba\ufb01on irrthe  uf’ V L’<\/p>\n
The appcllanfs probation was deeB3red_  the “cas;lIe,,:\u00a7of Junior
\nEngineer with e\ufb01ect from  ?3iif\u00a7l:lre’orticr declaring the
\nprobation was passed pnly:-On”  1″ Annexure-B<\/p>\n
order dated 30.1;    V’ ::;'”ot1:.cr words, by the<\/p>\n
time the prob\u00e9iieziiiieoi;  deciarcd the new Rule
\ninsisting oxra mH1Im”  V’   seven years had already come<\/p>\n
intoforce.  * 2\n<\/p>\n
6. Even \u00bbt1_1ough-..  method of xecnzitmcnt to the post of<\/p>\n
  appointment by transfer in addition to<\/p>\n
the  ‘ and promotion the materials placed on<\/p>\n
     any ratio for each of the methods.\n<\/p>\n
-. ji\ufb01herefom, “e\u00a7en if the method of Ieczuitxnent provided for<\/p>\n
 by transfer. the appe\ufb01ant could not have clann’ ed<\/p>\n
  ggrzent as a matter of mg’ ht. Neither the petitioner in the Writ<\/p>\n
petition nor the respondent in the statement of <\/p>\n
disclosed Whether there were any other quali\ufb01ed   <\/p>\n
who were senior to the appe\ufb02ant in \ufb023e.ead_:e of d” V<\/p>\n
during the xelevant period.\n<\/p>\n
7. The claim of the appellant cou’kl:Vxi1ot    Vt<\/p>\n
for yet another reason.  isyiio ‘evetiaent that dtzling the
\nperiod from 06.09.1996 and \u00a330.11  fepvjaellant had made
\nany request for appoititmenitfee u Even a\ufb02er<\/p>\n
declaration of wide  ogtier dated 22.05.1997,<\/p>\n
the appe\ufb02alttd did’ ~  immediately. The
\nappellant at-3 ilsequest for the titst time only in
\nthe year 1099  Wes  vide Annexune~C order dated
\n a_He   ehallenge Annexure~C order in any Court<\/p>\n
of  Vt  He appears to have made further<\/p>\n
‘ Vt o’*A….repIese’3attei’tion_  was rejected vide Annexurev-D order dated<\/p>\n
  he kept quiet for another two years; and \ufb01led the<\/p>\n
 on 27.10.2003. Hence the respondent was justi\ufb01ed in<\/p>\n
  contention in the statement of objections that the writ<\/p>\n
,’  liable to be dismissed on the ground of delay and<\/p>\n
laches alike. In the above circumstances, we do not \ufb01n?! any   <\/p>\n
in the Writ appeal, the Writ appeal is dismissed.<\/p>\n
