Investigation is over, charge-sheet is filed.<br \/>\n\tPetitioner is in jail since 16th November, 2010. He<br \/>\n\tfurther pointed out that she and the petitioner were residing as<br \/>\n\thusband and wife.\n<\/p>\n<p>Since<br \/>\n\tthe trial is yet to be conducted, it would not be appropriate on my<br \/>\n\tpart to make any conclusive observations in submissions made above.<br \/>\n\tHowever, looking to the nature of allegations in the complaint and<br \/>\n\tthe evidence collected by the Investigating Agency, when I find that<br \/>\n\tcharge-sheet is already filed, I am of the opinion that petitioner<br \/>\n\tis not required to detain in custody any longer.\n<\/p>\n<p>Considering<br \/>\n\tthe above prima facie aspects of the matter, I find this is a fit<br \/>\n\tcase for granting bail. Under the circumstances, the applicant is<br \/>\n\tordered to be released on bail in connection with C.R.No.I-227 of<br \/>\n\t2010 registered with Kalol Taluka Police Station, Dist. Gandhinagar,<br \/>\n\ton his furnishing bond of Rs. 25,000\/-(Rupees Twenty Five Thousand)<br \/>\n\twith one surety of like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to following conditions :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
