RAMACHANDRA MENON, J.\n             ..............................................................................\n                      W.P.(C) No. 23598 OF 2010\n              .........................................................................\n                     Dated this the 13th August , 2010\n\n\n\n                                   J U D G M E N T\n<\/pre>\n<p>       The petitioner is mainly stated as aggrieved of Exts. P3<\/p>\n<p>and P4 notices              whereby substantial amounts have been<\/p>\n<p>demanded by way of arrears of tax under the Kerala Motor<\/p>\n<p>Vehicles Taxation Act in respect of the vehicle bearing No. KL-<\/p>\n<p>2\/U-1177 belonging to the petitioner, which according to him, is<\/p>\n<p>not liable to be satisfied under any circumstances, stating that<\/p>\n<p>he had submitted the requisite &#8216;G&#8217; Forms for the period in<\/p>\n<p>question.\n<\/p>\n<p>     2.   The learned Government Pleader                                        appearing for the<\/p>\n<p>respondents submits that the matter has already been<\/p>\n<p>considered.   The factual position is not controverted from the<\/p>\n<p>part of the respondents.                  The learned Government Pleader also<\/p>\n<p>submits that the petitioner is very                             much having an alternate<\/p>\n<p>remedy, if at all aggrieved in any manner, by challenging the<\/p>\n<p>impugned order passed by the RTO by approaching the Deputy<\/p>\n<p>W.P.(C) No. 23598 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>Transport   Commissioner as provided under the relevant<\/p>\n<p>provisions of law.\n<\/p>\n<p>      3. The learned Counsel for the petitioner submits that the<\/p>\n<p>petitioner may be permitted     to avail the statutory remedy and<\/p>\n<p>that the petitioner is constrained to approach this Court only<\/p>\n<p>because of the recovery proceedings pursued in the meanwhile.<\/p>\n<p>      4. Considering the facts and circumstances of the case, the<\/p>\n<p>petitioner is relegated to      avail the statutory remedy      by<\/p>\n<p>approaching the Deputy Transport Commissioner with regard to<\/p>\n<p>the cause of action projected in the Writ Petition.      So as to<\/p>\n<p>enable the      petitioner to pursue such steps,        all further<\/p>\n<p>proceedings pursuant to Exts. P3 and P4           shall be kept in<\/p>\n<p>abeyance for a period of one month.\n<\/p>\n<p>      The Writ Petition is disposed of.\n<\/p>\n<\/p>\n<p>                                 P.R.
