Heard learned counsel for the appellants and<\/p>\n<p>                     learned counsel for the State.\n<\/p>\n<p>                               2. The appellants have been convicted under<\/p>\n<p>                     Section 307\/34 of the Indian Penal Code. Appellant No. 1,<\/p>\n<p>                     Ram Lal Singh has been sentenced to undergo rigorous<\/p>\n<p>                     imprisonment for five years and Appellant No. 2 Pramod<\/p>\n<p>                     Singh alias Chutus singh has been sentenced to undergo<\/p>\n<p>                     rigorous imprisonment for seven years.\n<\/p>\n<p>                               3. The prosecution case as alleged by the<br \/>\n<span class=\"hidden_text\">              2<\/span><\/p>\n<p>informant Bhudeo Prasad Yadav that he heard the sound of<\/p>\n<p>cry and then family members ran there and saw his<\/p>\n<p>nephew Sunil Yadav fallen injured state. He disclosed that<\/p>\n<p>Ram Lal Singh and Pramod Singh have assaulted by<\/p>\n<p>Hasua and Pathria.     Thereafter, he got unconscious till<\/p>\n<p>today of Fardbeyan.     There is injury on his ear, nose,<\/p>\n<p>mouth and neck. On the basis of Fardbeyan, F.I.R. was<\/p>\n<p>lodged. After investigation, charge sheet submitted. On<\/p>\n<p>submission of the charge sheet, cognizance taken and the<\/p>\n<p>case was committed to the Court of Sessions where the<\/p>\n<p>charge was framed under Section 307\/34 of I.P.C.<\/p>\n<p>         4. During trial ten witnesses were examined, who<\/p>\n<p>are P.W.1, Bisundeo Yadav, P.W. 2, Govind Mandal, P.W.<\/p>\n<p>3, Rajendra Yadav, P.W.4, manoj Yadav, P.W.5, Radha<\/p>\n<p>Devi, P.W.6, Sunil Kumar Yadav, P.W. 7, Bhudeo Yadav,<\/p>\n<p>P.W. 8, Dr. N. K. Choudhary, P.W.9, Deep Narain Singh<\/p>\n<p>and P.W. 10, Ram Narain Singh.         On considering both<\/p>\n<p>oral and documentary evidence, the order of conviction<\/p>\n<p>was recorded.\n<\/p>\n<p>         5. Learned counsel for the appellants however,<\/p>\n<p>contends that in the prosecution case, there is contradiction<\/p>\n<p>in weapon used and in the Fardbeyan there is mentioned<br \/>\n<span class=\"hidden_text\">              3<\/span><\/p>\n<p>that weapon is Hasua and Pathria, bur during the trial it<\/p>\n<p>has developed Pasiyani Hasua and the injury report is<\/p>\n<p>copied and hence copy of injury report has not been<\/p>\n<p>proved and the evidence of the Doctor on the basis of copy<\/p>\n<p>alleged to be original is not sustainable and in the<\/p>\n<p>secondary evidence it has not been established and no step<\/p>\n<p>has been taken for bringing the original and original injury<\/p>\n<p>report has not been brought to prove the injury and the I.O.<\/p>\n<p>has also not been examined and there is contradiction in<\/p>\n<p>the evidence of the evidence of the witnesses who are<\/p>\n<p>interested and inimical and     hence, there could not be<\/p>\n<p>brought to be reliable. Hence, prosecution has not been<\/p>\n<p>able to prove the charges.\n<\/p>\n<p>         6. However, the prosecution in the Fardbeyan of<\/p>\n<p>the informant, Bhudeo Yadav, P.W. 7 stated that on cry of<\/p>\n<p>Sunil Yadav, he along with other family members ran and<\/p>\n<p>found his nephew Sunil Yadav is injured state fallen there<\/p>\n<p>who disclosed on inquiry that Ram Lal Singh and Pramod<\/p>\n<p>Singh have assaulted by Hasua and Pathria, but he could<\/p>\n<p>not speak out why he was assaulted and got unconscious<\/p>\n<p>and is still unconscious so Fardbeyan of Bhudeo Yadav<\/p>\n<p>was recorded by A.S.I. on 27. 03. 1986 at about 11 hours,<br \/>\n<span class=\"hidden_text\">              4<\/span><\/p>\n<p>though, occurrence alleged to quarters to 12 mid night in<\/p>\n<p>the preceding night.\n<\/p>\n<p>           7. However, P.W. 7, the informant has<\/p>\n<p>supported the prosecution case in the Fardbeyan, but that<\/p>\n<p>one difference is there that he has stated on enquiry Sunil<\/p>\n<p>Yadav disclosed that Ram Lal Singh and Pramod Singh<\/p>\n<p>assaulted by Pasiyani Hasua and he was taken to Medical<\/p>\n<p>College Hospital, Bhagalpur where Daroga recorded in his<\/p>\n<p>statement since the victim was still unconscious.<\/p>\n<p>         8. However, P.W. 1 has also supported the<\/p>\n<p>prosecution case and has stated that on hulla he along with<\/p>\n<p>three persons P.W. 1, 7 and 4 ran to the place where Sunil<\/p>\n<p>was lying injured and disclosed about assault by Pramod<\/p>\n<p>Singh and Ram Lal Singh by Pasiyani Hasua. P.W. 4 has<\/p>\n<p>also supported. However, has developed that he identified<\/p>\n<p>two persons fleeing away were Ram Lal Singh and<\/p>\n<p>Pramod Singh. However, P.W. 1 has stated that he along<\/p>\n<p>with P.W. 5 and 4 went to the place of occurrence, P.W.1<\/p>\n<p>and 7 have not stated about fleeing away of two persons.<\/p>\n<p>         9. P.W. 6 is the victim. However, he has stated in<\/p>\n<p>his evidence that he was singing holy song at the darwaja<\/p>\n<p>of Mukhiyaji. Pramod also singing holy son and Pramod<br \/>\n<span class=\"hidden_text\">             5<\/span><\/p>\n<p>asked to follow him to his dinner. Then he went there. He<\/p>\n<p>has further stated he took meal and sat in a room on cot<\/p>\n<p>then it is alleged that Pramod came with a rope and tied<\/p>\n<p>with his neck or try to pull it and Ram Lal assaulted by<\/p>\n<p>Pasiyani Hasua on his neck then he start fleeing and fell<\/p>\n<p>down on the back of his house. Both accused persons also<\/p>\n<p>chased him and assaulted him on fallen state and on hulla<\/p>\n<p>inmate of the house came then accused persons flee away<\/p>\n<p>then they carried him and he disclosed about assault. His<\/p>\n<p>statement was recorded after 2-3 days. However, he has<\/p>\n<p>stated that there is enmity with the accused persons with<\/p>\n<p>regard to the land. He has further stated that there was<\/p>\n<p>enmity. He has further stated that house of Mahesh is at a<\/p>\n<p>distance of 5-7 katha in the west and house of the accused<\/p>\n<p>persons about 15 to 20 steps from the house of Mahesh.<\/p>\n<p>He has further stated he was singing holy song and there<\/p>\n<p>are several people, but he did not remember who was<\/p>\n<p>drumming Dhol and who was on Jhal. He has further<\/p>\n<p>stated that he was singing song and from the house of<\/p>\n<p>Mukhiyaji even to take dinner and he had made hulla at<\/p>\n<p>the dawarja of the Mahesh.\n<\/p>\n<p>         10. P.W. 7, Bhudeo Yadav has stated in his<br \/>\n<span class=\"hidden_text\">              6<\/span><\/p>\n<p>evidence that at the time he ran to the place of occurrence<\/p>\n<p>at that time also singing of the village was going on, but<\/p>\n<p>none came there. He has further stated that he went to the<\/p>\n<p>persons who were singing, but none came. He has further<\/p>\n<p>stated that Police Chouki at a distance about 1\/4 k.m. and<\/p>\n<p>Jawahar Talkies House at a distance of 40 yards and Fari is<\/p>\n<p>at distance of 250 yards, but they did not go to the Fari.<\/p>\n<p>He has further stated that several people of the village<\/p>\n<p>came to the dawarja, but he can not say the person came<\/p>\n<p>was his friend or not ?\n<\/p>\n<p>         11. However, P.W. 8, is the Doctor, who<\/p>\n<p>examined in the case has proved the injury of Sunil Yadav<\/p>\n<p>and has stated that the following injuries;<\/p>\n<blockquote><p>         1. Incised wound 8&#8243; x 2-1\/2&#8243; mandible has been<br \/>\n             incised      extending from cheek sharing to left<br \/>\n             side cutting of occipital region with loss of<br \/>\n             lobula.\n<\/p><\/blockquote>\n<blockquote><p>         2. Incised wound 5&#8243;x 3-1\/4&#8243; muscle deep<br \/>\n             antsialy and bone incised postriaty. Left side<br \/>\n             of face above injury no. 1 exticing across the<br \/>\n             pinne of left ear to the mastoid region of left<br \/>\n             temporal bone.\n<\/p><\/blockquote>\n<blockquote><p>         3. Incised wound 1&#8243; x \u00be&#8221; skin deep left<br \/>\n             shoulder.\n<\/p><\/blockquote>\n<blockquote><p>         4. Incised wound 2&#8243; x 1&#8243;x muscle deep- Left<br \/>\n<span class=\"hidden_text\">             7<\/span><\/p>\n<p>            side of upper part of neck.\n<\/p><\/blockquote>\n<blockquote><p>         5. Incised wound 3&#8243;x 3\/4&#8243; bone exposed- Left<br \/>\n            side of cheek extending from filtrum to left<br \/>\n            rygomatic region.\n<\/p><\/blockquote>\n<blockquote><p>         6. Incised wound 5&#8243;x 3&#8243; bone exposed- Rt.<br \/>\n            Deltoid region.\n<\/p><\/blockquote>\n<blockquote><p>            Pulse was not fill at the time of admission.<br \/>\n            B.P. was also not recorded and has proved<br \/>\n            injury report in his pen as Exhibit-3.\n<\/p><\/blockquote>\n<blockquote><p>                12.   However, he has stated in his cross-\n<\/p><\/blockquote>\n<p>examination that at what time he examined the patient is<\/p>\n<p>not mentioned in his report. He has not further stated that<\/p>\n<p>at what time he was on duty that he can not say without<\/p>\n<p>taking to his duty card., He has further stated that the<\/p>\n<p>patient has directly appeared and was informed by him.<\/p>\n<p>He was on duty, but no Incharge of the emergency ward<\/p>\n<p>was there when the patient turned then he examined the<\/p>\n<p>patient on that day.      He has further stated that at the<\/p>\n<p>moment there is not record at what time of admission and<\/p>\n<p>examination and discharge of the patient. However, injury<\/p>\n<p>report Exhibit-3 has been proved which bears signature on<\/p>\n<p>27. 06. 1986.\n<\/p>\n<p>                13. However, injury report Exhibit 3, is dated<\/p>\n<p>27. 06. 1986 whereas Doctor in his evidence stated that he<br \/>\n<span class=\"hidden_text\">              8<\/span><\/p>\n<p>examined on 23. 03. 1986 in his evidence and time of<\/p>\n<p>examination has not been mentioned neither in his<\/p>\n<p>evidence nor in the injury report. However, six injuries<\/p>\n<p>were mentioned. Out of six, two injuries have been shown<\/p>\n<p>to be grievous and rests are simple.      However, injury<\/p>\n<p>shows grievous are sharp cutting but there is no reason<\/p>\n<p>assigned for. However, Injury No. 1 shown to be grievous<\/p>\n<p>due to loss of lobule.\n<\/p>\n<p>          14. However, during argument, it has been<\/p>\n<p>impressed that the Doctor may have copied out injury<\/p>\n<p>from the injury register.   However, injury report itself<\/p>\n<p>appears to be doubtful when the date of occurrence is 27.<\/p>\n<p>03. 1986 and injury report is dated 27. 06. 1986 and there<\/p>\n<p>is no mentioned in the reason about change of date either<\/p>\n<p>in his evidence or in the injury report and even learned<\/p>\n<p>counsel for the appellants has contends that if it is copied<\/p>\n<p>out any original then it is secondary evidence and does not<\/p>\n<p>at all shown where original is lying and no attempt was<\/p>\n<p>made for bringing the original injury register to prove the<\/p>\n<p>injury.\n<\/p>\n<p>           15. However, having regard to the fact, Doctor<\/p>\n<p>gave evidence on the basis of Exhibit-3 injury report<br \/>\n<span class=\"hidden_text\">               9<\/span><\/p>\n<p>which does not mention the time. Doctor in his evidence<\/p>\n<p>has stated that he did not remember when he examined the<\/p>\n<p>patient and time has not been mentioned in his report and<\/p>\n<p>hence time of occurrence not mentioned when there is no<\/p>\n<p>mentioned when he examined the patient in the injury<\/p>\n<p>report does not mention the date and time of examination.<\/p>\n<p>            16. Hence, taking into consideration of<\/p>\n<p>evidence of the Doctor and injury report, the injury report<\/p>\n<p>does not inspire confidence. The I.O. has also not been<\/p>\n<p>examined.\n<\/p>\n<p>            17.   Taking into consideration the facts and<\/p>\n<p>circumstances, though, P.W. 1, 3, 4 and 7 has supported<\/p>\n<p>the prosecution case about assault, though, P.W. 1, 4, 6<\/p>\n<p>and 7 have supported the prosecution about assault, but<\/p>\n<p>P.W. 1, 3, 4 and 7 are interested witnesses and there is<\/p>\n<p>contradiction about weapons. Further development, P.W.4<\/p>\n<p>says that he saw two persons fleeing away and victim also<\/p>\n<p>says that he saw two persons came and assaulted him,<\/p>\n<p>however, in the prosecution case that appellants singing<\/p>\n<p>holy song in the village and he went with accused to take<\/p>\n<p>dinner on the request of Pramod. However, there is prior<\/p>\n<p>enmity between the parties. Further, about the occurrence,<br \/>\n<span class=\"hidden_text\">              10<\/span><\/p>\n<p>P.W. 7 has stated that several persons came. He has also<\/p>\n<p>stated at the time of singing holy song in the village going<\/p>\n<p>on he went and informed the persons who singing song,<\/p>\n<p>but they did not turn up. He has also stated that there are<\/p>\n<p>houses of several persons who are follows, but none turn<\/p>\n<p>up. No independent witness has turn up in the prosecution<\/p>\n<p>case to depose and evidence of the Doctor does not inspire<\/p>\n<p>confidence neither original injury report has been brought<\/p>\n<p>and the injury report proved Exhibit 3 is dated 27. 06.<\/p>\n<p>1986 whereas occurrence is dated 27. 03. 1986 and there is<\/p>\n<p>no explanation by the Doctor about date. Further evidence<\/p>\n<p>of the Doctor that he did not record the time, hence<\/p>\n<p>evidence of the Doctor stated above does not inspire<\/p>\n<p>confidence. The I.O. has also not been examined in this<\/p>\n<p>case and no independent witness has turn up to support the<\/p>\n<p>prosecution case when the prosecution case is that victim<\/p>\n<p>was singing holy song in the village, but none turned up.<\/p>\n<p>P.W. 7 though, has stated that several persons came in the<\/p>\n<p>house after occurrence. Further it has come in evidence<\/p>\n<p>that Fari and T.O.P. at a distance of few yards\/ at a quarter<\/p>\n<p>mile, but matter not reported in the night and F.I.R. drawn<\/p>\n<p>on the next date itself cast doubt.\n<\/p>\n<p><span class=\"hidden_text\">                                  11<\/span><\/p>\n<p>                             18. Hence, under the facts and circumstances, I<\/p>\n<p>                  find and hold that in this case, accused persons are entitled<\/p>\n<p>                  to benefit of doubt as the prosecution has not been able to<\/p>\n<p>                  prove the charges beyond all reasonable doubt. Hence<\/p>\n<p>                  order of conviction and sentence recorded by the lower<\/p>\n<p>                  court is hereby set aside and the appeal is accordingly<\/p>\n<p>                  allowed.
