Saxena\nRespondent Counsel :- Arvind Kumar Srivastava\n\nHon'ble Sunil Ambwani,J.\n<\/pre>\n<p>Hon&#8217;ble Kashi Nath Pandey,J.\n<\/p>\n<p>We have heard learned standing counsel for the appellants.<br \/>\nSri A.K. Srivastava appears for respondents.\n<\/p>\n<p>This Special Appeal has been filed against the judgment of<br \/>\nthe learned Single Judge dated 19.9.1996 by which he<br \/>\nentertained the writ petition filed by Chaturth Shreni Ban<br \/>\nKaramchari Sangh, U.P., Ballia, for payment of minimum<br \/>\nwages to the daily wagers, and disposed of the matter on<br \/>\nthe same day, purportedly with the consent of learned<br \/>\ncounsel for the parties, as the law which was prevailing at<br \/>\nthat time with following directions:-\n<\/p>\n<p>&#8220;The writ petition, for the reasons given above, succeeds in<br \/>\npart. The respondents are directed to pay salary to the<br \/>\nmembers of the Association numbering 30 disclosed in<br \/>\nannexure-1 to this writ petition as is being given and paid to<br \/>\nthe regular employees of the department in the same cadre<br \/>\nand the respondents are further commanded to give benefit<br \/>\nof judgement of this Court in Civil Misc. Writ Petition No.<br \/>\n15627 of 1998. It is, however, clarified that the respondents<br \/>\nshall pay to the employees mentioned in annexure-1 to this<br \/>\nwrit petition wages\/salary at the rates equivalent in the<br \/>\nminimum pay-scale of regular employees in the<br \/>\ncorresponding cadre but without any increment w.e.f.<br \/>\n16.8.1996 viz., the date of presentation of this writ petition in<br \/>\nin this Court.&#8221;\n<\/p>\n<p>A large number of writ petitions were decided with directions<br \/>\nfor regularization of daily wage employees of the Forest<br \/>\nDepartment.\n<\/p>\n<p>In State of U.P. and others Vs. Putti Lal [2002 (3) AWC<br \/>\n2375] decided on 21.2.2002, the Supreme Court considered<br \/>\n and decided a batch of appeals with directions to consider<br \/>\nall such employees for regularization under the Rules made<br \/>\nunder the proviso to Article 309 of the Constitution called<br \/>\n&#8216;Uttar Pradesh Regularization of Daily Wages Appointment<br \/>\non Group &#8216;D&#8217; Posts Rules, 2001&#8242;. Since a statutory rule was<br \/>\nframed indicating the manner in which the daily wagers can<br \/>\nbe regularized, the Supreme Court observed that the<br \/>\nquestion of framing any further scheme for regularization of<br \/>\ndaily wagers of Forest Department did not arise.\n<\/p>\n<p>On the question of payment of wages, on the principle of<br \/>\nequal pay for equal work, the Supreme Court directed as<br \/>\nfollows:-\n<\/p>\n<p>&#8220;5. In several cases, this Court, applying the principle of equal pay for<br \/>\nequal work has held that a daily-wager, if he is discharging the similar<br \/>\nduties as those in the regular employment of the Government, should<br \/>\nat least be entitled to receive the minimum of the pay-scale though he<br \/>\nmight not be entitled to any increment or any other allowance that is<br \/>\npermissible to his counterpart in the Government. In our opinion, that<br \/>\nwould be the correct position and we, therefore, direct that these daily-<br \/>\nwagers would be entitled to draw at the minimum of the pay-scale<br \/>\nbeing received by their counter-part in the Government and would not<br \/>\nbe entitled to any other allowances or increment so long as they<br \/>\ncontinue as daily-wager. The question of their regular absorption will<br \/>\nobviously be dealt with in accordance with the statutory rule already<br \/>\nreferred to.&#8221;\n<\/p>\n<p>The judgment in Putti Lal&#8217;s case (Supra) was followed by this<br \/>\nCourt in Janardan Yadav Vs. State of U.P. and another<br \/>\n[(2008) 1 UPLBEC 498] and Sri Ram Yadav Vs. State of<br \/>\nU.P. and others [(2008) 2 UPLBEC 1533].\n<\/p>\n<p>The learned standing counsel submits that the Supreme<br \/>\nCourt has in subsequent decisions held that the daily-wager<br \/>\nis not entitled to minimum of pay scale and that until<br \/>\nregularization, the daily wager is only entitled to continue on<br \/>\ndaily wage basis.\n<\/p>\n<p>In the present case, since in respect of similarly situated<br \/>\nemployees, the Supreme Court has given directions in Putti<br \/>\nLal&#8217;s case (Supra) on 21.2.2002, we do not find good ground<br \/>\nto deviate and to allow discrimination to the similarly<br \/>\nsituated employees.\n<\/p>\n<p>The Special Appeal is accordingly disposed of with same<br \/>\ndirections as are contained in Putti Lal (Supra)&#8217;s case. The<br \/>\npetitioners shall be considered for regularization under the<br \/>\n Rules of 2001 until then they will be continued to be paid<br \/>\nwages in the minimum of the pay scale, which is being paid<br \/>\nto the regular employees, discharging same duties.\n<\/p>\n<p>Order Date :- 2.8.2010<br \/>\nnethra\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court State Of U.P.
