\nsame had been    judgment and<\/p>\n

thereto, the resporiicienit’hgeireinwinstituted Execution Petitions in<\/p>\n
EP No.17?)\/.2007,i’s5,r.\u00e9ooi*7,i 160\/2007 and 176\/2007<\/p>\n
respectively, In .. pending execution proceedings, the<\/p>\n
 had filed applications under Section 47 R\/W<\/p>\n
Sectio”n   raising certain contentions indicating that<\/p>\n
 the jud_gment.and decree is null and void and the same cannot<\/p>\n
 execuitedil One of the contentions urged therein is that all<\/p>\n
  itrllsit property and committee members shall be under the<\/p>\n
\u00ab  ‘Control Of Chairman as p\u00e9r the scheme. Insofar as the trust,<\/p>\n

Petitions, the learned Counsel foifAithe.ipeti'tionets' hvastirged the

detail. While considering this aspectiiiof the’ mat’ter’~rega’i’.dinVg’\u00bb.<\/p>\n

Executing Court has rnadespecific—-reference to the-original suit
\nwherein the said contention”had,_vbeen\ufb02:’dec,ided and also the
\nsame contention affirmed i:nVV’the;\u00a71ppeap1.,.   I<\/p>\n
7. In a   ‘convinced that the
\nEXecuting’iVCou’rt.:.:’yvas;\u00a7ustiifie.d’ in iiitsiiiconciusion since it is not
\nopen for  to .urge the said contention in<\/p>\n
the Executir1gi”-Courtf.wh.en”~*”the very same issue has been<\/p>\n
‘Vconsidei’ed;_.,arid the iipev—Ltioners herein had failed in the appeal<\/p>\n
‘a.sw\u00e911;._ this Court had expressed the View that this<\/p>\n
 ..  Court Would’ riot interfere on merits and it was suggested that if<\/p>\n
 the respondents are agreeable not to press the point any<\/p>\n
