No.11199 of 2011\n                               MANOHAR MAHTO\n                                      Versus\n                              THE STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>2   19.04.2011             Heard learned counsel for the petitioner as<\/p>\n<p>                 well as learned Additional Public Prosecutor for the<\/p>\n<p>                 State.\n<\/p>\n<p>                           Admittedly, there is case and counter case<\/p>\n<p>                 between the parties and there is allegation against the<\/p>\n<p>                 petitioner that he opened fire causing firearm injury on<\/p>\n<p>                 the elbow of injured Gauri Shankar Prasad. It appears<\/p>\n<p>                 that the learned Sessions judge has observed that the<\/p>\n<p>                 aforesaid Gauri Shankar Prasad has sustained simple<\/p>\n<p>                 injury though said to be caused by firearm.<\/p>\n<p>                           Learned counsel for the petitioner points out<\/p>\n<p>                 that elbow is not the vital part of the body and in course<\/p>\n<p>                 of investigation, two versions have come regarding<\/p>\n<p>                 causing injury to the above stated injured Gauri<\/p>\n<p>                 Shankar Prasad which is evident from perusal of<\/p>\n<p>                 impugned order of learned Sessions Judge itself.<\/p>\n<p>                           Learned counsel appearing for the informant<\/p>\n<p>                 opposed the prayer pointing out that petitioner carries<\/p>\n<p>                 criminal antecedent and the alleged occurrence took<\/p>\n<p>                 place on account of demand of extortion money but I am<\/p>\n<p>                 not at all convinced with this submission, because<\/p>\n<p>                 admittedly, petitioner is co-villager of the informant and<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>     there was land dispute between the parties.<\/p>\n<p>              Taking into consideration the above stated<\/p>\n<p>     facts and circumstances as well as submissions of the<\/p>\n<p>     parties, let the petitioner, namely, Manohar Mahto be<\/p>\n<p>     released on bail on furnishing bail bonds of Rs.10,000\/-<\/p>\n<p>     (Ten Thousand) with two sureties of the like amount<\/p>\n<p>     each to the satisfaction of learned C.J.M., Khagaria in<\/p>\n<p>     connection with Khagaria (Gangaur) P.S.
