No. 648 of 2009\n               ---------------------------------------------------\n           Dated this the 16th day of February, 2009.\n\n                                   ORDER\n<\/pre>\n<p>           Petition for anticipatory bail.\n<\/p>\n<p>           2. The alleged offences are under Sections 407, 409,<\/p>\n<p>420, 477A and 34 of IPC. According to prosecution, A1, who is a<\/p>\n<p>Mahila Pradan Agent, collected various amounts from depositors<\/p>\n<p>even during the period while she was under suspension and<\/p>\n<p>misappropriated the amount without depositing the same in the<\/p>\n<p>post office. The 2nd accused, who was the Sub Post Master, who<\/p>\n<p>was in exclusive possession of the stamps, office seal etc. but<\/p>\n<p>those were used by first accused for creating documents to use<\/p>\n<p>it as genuine and thereby both accused committed offence in<\/p>\n<p>furtherance of common intention.\n<\/p>\n<p>           3. Learned counsel for              petitioner        submitted that<\/p>\n<p>petitioner retired as early as on 31.3.2007 and the crime was<\/p>\n<p>registered only on 28.3.2008 i.e. after about one year of her<\/p>\n<p>retirement.   It is not clear during which period                  the relevant<\/p>\n<p>documents were created and how the office seal was obtained<\/p>\n<p>etc. It is not possible to make any                   conclusion     regarding<\/p>\n<p>involvement of petitioner, on the basis of the materials now<\/p>\n<p>available. Petitioner has not committed any offence, but after<\/p>\n<p>about one year of her retirement, she was implicated alleging<\/p>\n<p>that the office seal which was kept in her exclusive custody was<\/p>\n<p>used for the offence. She may be granted anticipatory bail, it it<\/p>\n<p>submitted.\n<\/p>\n<p><span class=\"hidden_text\">[[B.A. No.648\/09]                    2<\/span><\/p>\n<p>             4. Learned Public Prosecutor submitted that petitioner<\/p>\n<p>may be directed to appear before the investigating officer for<\/p>\n<p>interrogation and subject to that he has no objection in granting<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>             5. On hearing both sides,         I am satisfied that<\/p>\n<p>anticipatory bail can be granted to petitioner and the following<\/p>\n<p>order is passed:\n<\/p>\n<blockquote><p>             Petitioner shall surrender before the Magistrate Court<\/p>\n<p>             concerned within 7 days from today and she shall be<\/p>\n<p>             released on bail on her executing         a bond for<\/p>\n<p>             Rs.25,000\/- with two solvent sureties each for the like<\/p>\n<p>             sum to the satisfaction of learned Magistrate, on the<\/p>\n<p>             following conditions:\n<\/p><\/blockquote>\n<blockquote><p>                   i) The petitioner shall co-operate with the<\/p>\n<p>                        investigation    and   make   herself<\/p>\n<p>                        available for interrogation as and<\/p>\n<p>                        when directed.\n<\/p><\/blockquote>\n<blockquote><p>                   ii) The petitioner shall not influence or<\/p>\n<p>                        intimidate    any witness or  tamper<\/p>\n<p>                        with evidence or commit any offence<\/p>\n<p>                        while on bail.\n<\/p><\/blockquote>\n<blockquote><p>\n                 This petition is allowed.<\/p>\n<\/blockquote>\n<blockquote><p>                                          K.
