SUPAUL, DISTRICT SUPAUL.\n                                          Versus\n                              The State Of Bihar &amp; Ors\n                             ----------------------------------\n<\/pre>\n<p>2   01\/08\/2011            So long authenticity of annexure-5 is not<\/p>\n<p>                  destroyed by some authentic material or evidence in this<\/p>\n<p>                  regard, the ground urged by the petitioner that respondent<\/p>\n<p>                  no. 5 has procured service on a false certificate of<\/p>\n<p>                  education cannot form circumstance or basis for<\/p>\n<p>                  interference in this writ application.<\/p>\n<p>                          The Court is mindful of the fact that after the<\/p>\n<p>                  year 1990 post of Chowkidar also became a civil post<\/p>\n<p>                  under the State and it is no longer an inheritable right.<\/p>\n<p>                  Any selection made to such post has to meet the test of<\/p>\n<p>                  Articles 14 and 16 of the Constitution of India.<\/p>\n<p>                          In that view of the matter, the claim of the<\/p>\n<p>                  petitioner for his appointment as a matter of right does<\/p>\n<p>                  not exist due to the changed circumstance.<\/p>\n<p>                          So far as authenticity of annexure-5 is concerned,<\/p>\n<p>                  petitioner will have to obtain evidence in this regard and<\/p>\n<p>                  if he lays his hands on this clinching evidence, he may<\/p>\n<p>                  have the occasion to move the authority on this score for<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>        annulment of appointment of respondent no. 5 Satya<\/p>\n<p>        Narayan Yadav.\n<\/p>\n<p>                This writ application is otherwise dismissed with<\/p>\n<p>        the observation aforesaid.\n<\/p>\n<\/p>\n<pre>AMIN\/                (Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Kalam vs The State Of Bihar &amp; Ors on 1 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CIVIL WRIT JURISDICTION CASE No.5876 of 2011 Md.Kalam SON OF MD.
