           Application for anticipatory bail. Petitioner is the 2nd<\/p>\n
accused.     He faces allegations in a crime registered for<\/p>\n
offences punishable, inter alia, under sections 407, 420 and<\/p>\n
120B read with 34 IPC. At present, as many as 16 persons<\/p>\n
are arrayed as accused.\n<\/p>\n
     2.    The facts of this crime are indeed strange and<\/p>\n
interesting. The Malabar Cements Limited(MCL) at Walayar is<\/p>\n
located on the highway between Tamil Nadu and Kerala.<\/p>\n
Strangely, it is located beyond the Kerala Sales Tax check<\/p>\n
post at Walayar where goods coming into Kerala in vehicles<\/p>\n
by road are checked. There is a peculiar arrangement for<\/p>\n
vehicles loaded with cement from the Malabar Cements<\/p>\n
Limited at Walayar which are to come into Kerala.                It is<\/p>\n
submitted that in 2006 this arrangement was struck.              The<\/p>\n
vehicles which are loaded with cement at Malabar Cements<\/p>\n

Limited which are to come into Kerala are given a<\/p>\n
metal token from the Malabar Cements Limited which will help<\/p>\n
such vehicles loaded with cement to pass through the check<\/p>\n
post through the green channel without any further checking.<\/p>\n
The vehicles are not subjected to any detailed scrutiny and<\/p>\n
they are not obliged to wait in the queue.       The criminals<\/p>\n
appear to have pitched upon this facility to ensure that spirit is<\/p>\n
moved into Kerala from the neighbouring State of Tamil Nadu.<\/p>\n
The arrangement is that when the vehicle loaded with cement<\/p>\n
from Malabar Cements Limited comes out of the gate of<\/p>\n
Malabar Cements Limited, another vehicle with the same<\/p>\n
(fake) number identical in all particulars like the one which<\/p>\n
goes out of the Malabar Cements Limited comes from Tamil<\/p>\n
Nadu side.    The token and the documents of the vehicle<\/p>\n
carrying cement from Malabar Cements Limited are handed<\/p>\n
over to such vehicle. Such vehicle takes the green channel.<\/p>\n
Such vehicle is loaded with larger quantities of spirit. Without<\/p>\n
any effective checking the spirit loaded vehicle conveniently<\/p>\n

finds passage into Kerala. This arrangement has obviously<\/p>\n
been going for a long period of time. One must be too naive<\/p>\n
to assume that this arrangement was going on only recently<\/p>\n
and the detection made in this case on 24.1.08 is one of the<\/p>\n
first consignments that came into Kerala.<\/p>\n
      3.    Be that as it may, it is now revealed that many such<\/p>\n
loads of illicit spirit have come into Kerala earlier making use<\/p>\n
of the peculiar facility conceded to Malabar Cements Limited.<\/p>\n
While the lorry loaded with spirit comes into Kerala, the lorry<\/p>\n
loaded with cement from Malabar Cements Limited proceeds<\/p>\n
towards Tamil Nadu. It is the case of the police that several<\/p>\n
persons are involved in this conspiracy to smuggle spirit into<\/p>\n
Kerala. Investigation into this conspiracy to facilitate illegal<\/p>\n
smuggling of spirit into Kerala is going on.<\/p>\n
      4.    The present story started when one inconvenient<\/p>\n
excise official appears to have intervened in the whole<\/p>\n
scheme.      He detected the offence and reported the fact<\/p>\n
promptly. The officials of the Malabar Cements Limited also<\/p>\n

lodged a complaint before the police. The excise crime and<\/p>\n
the police crime were being investigated separately. Now the<\/p>\n
investigation is taken over by the IGP Crimes who heads the<\/p>\n
ISISMIT. Investigation is going on.\n<\/p>\n
      5.   The petitioner is the 2nd accused in the crime<\/p>\n
registered by the police. The crux of the allegations against<\/p>\n
the petitioner is that he was also one of the conspirators. The<\/p>\n
data collected now shows that the cement loaded from the<\/p>\n
Malabar Cements Limited instead of coming into Kerala<\/p>\n
proceeds towards Tamil Nadu and it is the petitioner who is<\/p>\n
taking over the responsibility of disposing of such cement in<\/p>\n
Tamil Nadu. It is alleged that he distributes\/disposes of such<\/p>\n
cement much lesser prices than the prices at which the same<\/p>\n
is sold by the Malabar Cements Limited.            The police,<\/p>\n
therefore, allege that the petitioner is a conspirator who has<\/p>\n
full knowledge of the entire conspiracy to exploit the green<\/p>\n
channel facility and smuggle spirit into Kerala misusing the<\/p>\n
tokens\/documents issued by the Malabar Cements Limited.<\/p>\n

Investigation is in progress. The petitioner has not been<\/p>\n
arrested so far. He apprehends imminent arrest.<\/p>\n
      6.   The learned counsel for the petitioner submits that<\/p>\n
the petitioner is absolutely innocent.   He has absolutely<\/p>\n
nothing to do with the illicit import\/smuggling of spirit into<\/p>\n
Kerala. He has nothing to do with the disposal of the cement<\/p>\n
which is taken from Malabar Cements Limited towards Tamil<\/p>\n
Nadu. He has nothing to do with Nirmal Agencies which is<\/p>\n
said to have undertaken this responsibility of clandestine<\/p>\n
disposal of such cement.     In any view of the matter, the<\/p>\n
petitioner does not deserve to endure the trauma of arrest<\/p>\n
and detention. Anticipatory bail may be granted to him, it is<\/p>\n
prayed.\n<\/p>\n
      7.   The   learned  DGP      vehemently  opposes     the<\/p>\n
application. The learned DGP submits that it would be puerile<\/p>\n
at this stage to assume that the petitioner has no<\/p>\n
contumacious responsibility in the conspiracy or in the<\/p>\n
clandestine disposal of cement which moves out from the<\/p>\n

Malabar Cements Limited. My attention has been drawn to<\/p>\n
the case diary which, according to me, indicates clearly the<\/p>\n
complicity of the petitioner and the clandestine disposal by<\/p>\n
him of cement which goes into Tamil Nadu in place of the<\/p>\n
spirit loaded vehicles which move into Kerala exploiting the<\/p>\n
facility available.\n<\/p>\n
       8.   At this early stage of investigation,           I shall<\/p>\n
scrupulously avoid any detailed discussions on merits about<\/p>\n
the acceptability of the allegations or the credibility of the data<\/p>\n
collected. Suffice it to say that I am satisfied that all the<\/p>\n
available indications clearly suggest the complicity of the<\/p>\n
petitioner and at any rate, there are no circumstances<\/p>\n
justifying or warranting the invocation of the extraordinary<\/p>\n
equitable discretion under section 438 Cr.P.C.<\/p>\n
       9.   A perusal of the case diary in both the crimes, ie.<\/p>\n
excise and police crimes, reveals to me that the investigators<\/p>\n
have so far only touched the tip of the ice berg. The matter<\/p>\n
deserves more detailed and exhaustive investigation.              I<\/p>\n

\n                                : 7 :<\/span><\/p>\n
expect that the investigators in charge will do a proper and<\/p>\n
efficient job of the investigation entrusted to them and at any<\/p>\n
rate, I am not persuaded to agree that it is necessary to arm<\/p>\n
the petitioner with an order of anticipatory bail at this early<\/p>\n
stage. The petitioner must co-operate with the investigation.<\/p>\n
He must make himself available for interrogation by the<\/p>\n
investigating officer. There are no features whatsoever in this<\/p>\n
case which can persuade me to invoke the extraordinary<\/p>\n
equitable discretion under section 438 Cr.P.C.<\/p>\n
      10. This petition is dismissed. Needless to say, if the<\/p>\n
petitioner surrenders before the investigating officer or the<\/p>\n
learned Magistrate and applies for bail, after giving sufficient<\/p>\n
prior notice to the Prosecutor in charge of the case, the<\/p>\n
learned Magistrate must proceed to pass appropriate orders<\/p>\n
on merits, in accordance with law and expeditiously.<\/p>\n
