VTha$7facts leading to this appeal are\n\nl~u that the claimant, who is an agriculturist, was\n\n&quot; l\ufb01ial\ufb01g his bicycle from his field to his house\n\nl&quot;_ &quot;at ;Kadabagatti village on 11.12.2001, at about\n\n&quot;1\n\n\n\nA*._befo.r:\u00a7   Tribunal and ,. the\n\n3.20 pm., while he was so going a maxi cab\u00bb\n\nbearing No.KA-24\/4115 came from his \n\nand dashed against his bicycle, as a \n\nclaimant f ell down and s.uffered5_&quot; \n\nfractures and injures all  \n\nImmediately, he was \nHospital, Dharwad anci therVe4aV:ft,er.,_V he ijiaken\nto Hospital of   Dharwad,\nwhere he was an in  more\nthan 40 daysg:Tha\ufb01iingaajsuffered the\naforesaid   petition\nagainstcthei&quot;oiknerifif,&#039;ianriainsurerV\ufb02of maxi cab, who\nare  the Tribunal and\n\nalso in this&quot;~.proceedAi_n{:}:i&#039;.\n The 1&quot;&quot;&#039;respo&#039;r:dent\/owner remained exparte\n\n2nd\n\nres_p&#039;&lt;:i_1_1de11tV}&#039;v.insurance company was represented by\n\n its &quot;&quot;&#039;\u00ab.Coa..;_&#039;nsei\u00b0 and filed written statement.\n\n&quot;&#039;r.Thereaft&#039;e--r, issues were framed and evidence was\n\n&quot;\/5\n\n\n\nrecorded. The claimant examined himself as PW&quot;.----1\n\nand examined Dr M.C.Bellad as PW.2 and \n\ndocuments Exs.P1 to 15. Based on &#039;the pie-a:diI;&#039;gs\\,&quot;~ ,.4:0:lf.:al and\ndoucmentary evidenceA---..._..V:on&#039;  Tribunal\nawarded a sum of Rs,3._.Vd&#039;2..34\u00a2)?-\ufb02ehg:f_&#039;\u00a2@npensation\nto the claima&#039;nt\u00abf;a.ionr\u00a7&amp;   at 6% pa.,\nfrom the date  date of payment.\nThe .c}.aviInain&#039;tn~  the quantum of\ncompensation this appeal seeking\nenhancemenxtiiof *  \n\n  __this appeal also the 1&quot;\n\nres.po&#039;ndent.?_&#039; though served remained\n\n.unrepi&#039;esented. The 2&quot;&quot; respondent\/insurance\n\n&quot;*.&#039;*c;omp;any entered appearance through its counsel\n\n&quot;&quot;7\n\n\n\nand contested the appeal on merits. Heard the\n\nCounsel for the parties.\n\n6. On verification of the judgment land 5_l.\n\naward and the material on record, it&quot;&quot;isf,seenV\n\nthat the claimant has suffered ifi\ufb01eiafraot\ufb01fes V\ufb01d\n\nbesides injuries to the lower \ufb01agt of his hodt\nright from the waist and dse to the injaries he\nhas suffered, there Ties s\ufb01\u00a7%\ufb01\u00a7\u00a7is\u00a7=_of &#039;hisl left\nleg by two inches causino linoingytshocording to\n\nthe Doctor, PW;2;- who \u00a7hes*.\u00a7iven.ievidence and\n\nissued ioettifioatei&quot;Qfkidisahility, which is at\nEx.P5, the .olaimehtlzis.:not in a position to\n\nstand &#039;for \ufb02;ong,h Cannot walk, cannot squat,\n\n&quot;*c8n&quot;?\u00a3&#039; db Qhy lother&#039; work which he would have\n\nidone&quot;inathevno:mai course prior to the accident\n\nand that atcotding to the Doctor, the claimant\n\n~has s\ufb01ffeied physical disability to an extent of\n\nl3\u00a7%.tp his right lower limb and 50% to his lower\n\nIl:\u00a7\u00a7t~~and ankle and the claimant has also\n\n&quot;V?\n\n\n\nsuffered functional disability in using of hie&quot;o\n\nleg for his dayrto-day activity.\n\n7. Based on the evidence of the Dootor; the j &#039;\n\nTribunal has held that there is L{jisabi&#039;ii&#039;t;,}&#039; \n\n30% to the whole body or Hthe iolaimantfeand\u00a7\n\nproceeded to award co$pensatioaeunder&#039;the head\nof loss of future inoode,AlWhil\u00e9{deiug so, the\nTribunal has taken the ine\u00e9mergf the deoeased at\nRs.80\/+ pen \u00a7\u00a7i;7howe\u00a79\ufb01&amp;&quot;thiee\u20acourt is of the\nopinion that._the\u00a7 lribunel &quot;ought \u00b0to have taken\nthe  &#039;1&#039;Re.5;V1.1QA\u00a27\/la   If Rs.100\/- per\nday is taken as the inoome of the claimant, the\n\ncompensation *thatf Could be awarded to the\n\n;f\u00a2iiamant;,under &#039;d*ww&quot;head of loss of future\n\nearnihg_Ca@aCity would be Rs.1,94,400\/- instead\n\n  of \u00a7=zs;&quot;1&#039;,5S,~;&#039;$jg&lt;:j\u00a2 awarded by the Tribunal. Since\n\nl__ the inoo\ufb01e of the claimant is taken at Rs.100\/-\n\nd&#039;\ufb01er day, the loss of income during the period of\n\n.treetment also requires to be altere\ufb01q\ufb01. which\n\nW&#039;?\n\n\n\nthe Tribunal awarded at Rs.2,960\/-. Admittedly,\n\nthe claimant was inpatient for a period of \ufb01bre y\n\nthen 40 days and he would have taken. atleaet&quot;id*&quot;\n\nanother 40 to 50 days to resume to hie Qorkiandd\n\nthereby he would have been under treat\ufb01ent for ad7C\n\nperiod of three monthsedgz Aocordingl\u00a7g%,the\nclaimant is entitled to R3\u00e9\u00a7dOO\/~ towards }loss\nof income during the period of treatment.\n\n8. Though the Tribunal haS,aQarded a sum of\n\nRs.40,000\/- jtowardst pain ,\u00e9\ufb01a_ suffering, no\namount:iWha$eW_b\u00e9en &#039;Vawardedh&#039; towards injury\nseparatelyi. &#039;.He\ufb01ee;. the. compensation awarded\n\ntowards pain &quot;and, suffering is increased from\n\n~.as.4p&#039;,&quot;\u00ab:oQ(_\u00a7&#039;\/-__ to&quot;&quot;&quot;Rs...5.0,ooo;-. The Tribunal has\n\n&quot;v._,;1.\u00ab}:;o--\u00bb..aW3vraed\u00b0&quot;a.__ sum of Rs.25,000\/- towards loss\n\nof*narria\u00a7e prospects, which is required to be\n\n--enhanCed\ufb02 &quot;to Rs.35,000f- considering the\n\nd&#039;dieabilit\u00a7&#039; that he has sufffred to the lower\n\n:\u00bbli\ufb01b&#039;7of his body, which would considerably\n\n&quot;*7\n\n\n\nreduce his chance of getting married. Further,\n\nwhile granting compensation under the head- cf5_\n\nfollow--up treatment, a sum of only Rs.3,0QUf+iis\u20ac;&#039;\n\nawarded and attendant charges are not.V----.a_\u00a7faVrdied.,\n\nHence the compensation awarded underf the; same _j}\n\nhas to be enhanced to Rs.5,O00\/4;&#039;tHowev\u00e9r;&quot;thisi\n\nCourt is of the opinion thatv the *\u00e9\u00a2mp\u00e9n$a\u00a3i\u00a2n\nawarded towards medical expins\u00e9si fyture medical\nexpenses and nouriah\ufb01ent\ufb01i at dj\u00a7sf80,860\/W:\nRs._20,000\/-- ._g5.:j;gvv&#039;tj&quot;;:jt)}\u00e9-- is in\nOrder- ACC9f\u00e9%n\u00a7$\u00a7gi i\u00a7I&quot;V?\u00e9Wid0f&#039; the aforesaid\n\nmodification} the \u00a3otai&#039;conpensation payable to\nthe &lt;:laiman.tVwouidpibei&#039;-.Rs_.3,99,260\/-- instead of\n\nRs.3.3$.345f\u00a7 &quot;awardedk by the Tribunal.
