Justice M.SASIDHARAN NAMBIAR\n\n Dated :14\/12\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             Tr.P.(Crl.)No.51 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner, an Advocate practising in Kannur<\/p>\n<p>courts, who is the 9th accused in C.C.No.338\/2008 on<\/p>\n<p>the  file  of  Judicial  First   Class  Magistrate&#8217;s<\/p>\n<p>Court-I,  Kannur,  filed  this  petition  to   order<\/p>\n<p>transfer of the case to another court with a<\/p>\n<p>direction to hear the petitioner before framing<\/p>\n<p>charge, within a specified period, contending that<\/p>\n<p>case  is  being  adjourned,  as  petitioner  is   an<\/p>\n<p>Advocate practising in that court, the court has<\/p>\n<p>expressed the view that case is to be transferred.<\/p>\n<p>    2. A report was called for from Judicial First<\/p>\n<p>Class Magistrate-I, Kannur. The report shows that<\/p>\n<p>as petitioner is an Advocate and a member of Kannur<\/p>\n<p>Bar Association, who regularly appear before the<\/p>\n<p>court and filed vakalath in several cases, learned<\/p>\n<p>Magistrate  addressed  Chief  Judicial   Magistrate,<\/p>\n<p>Thalassery, requesting the court to transfer the<\/p>\n<p><span class=\"hidden_text\">TPCR 51\/10                 2<\/span><\/p>\n<p>case to some other court having jurisdiction and<\/p>\n<p>there    is  no  impediment  for the  Magistrate  to<\/p>\n<p>dispose    the  matter,  except that  petitioner   is<\/p>\n<p>regularly practising before that court.<\/p>\n<p>     3. So far, C.C.No.338\/2008 on the file of<\/p>\n<p>Judicial First Class Magistrate&#8217;s Court-I, Kannur<\/p>\n<p>is not transferred to any other court. Therefore, I<\/p>\n<p>find no necessity to issue a direction to hear the<\/p>\n<p>case by any other Magistrate. The fact that one of<\/p>\n<p>the accused is an Advocate practising in that court<\/p>\n<p>need not be a reason for the Magistrate to seek an<\/p>\n<p>order of transfer or refuse to try the case.
