He is languishing in jail custody since<\/p>\n<p>                   19.05.2010.\n<\/p>\n<p>                                 It is alleged against the petitioner to have caused<\/p>\n<p>                   fire-arm injury on the left eyebrow of the brother of the<\/p>\n<p>                   informant and thereafter one Hareram Manjhi caused fire-<\/p>\n<p>                   arm injuries on the back of head whereas Mukesh Jha caused<\/p>\n<p>                   fire-arm injury on the hand of the deceased.<\/p>\n<p>                                 It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that both sides are agnates and the petitioner is<\/p>\n<p>                   deprived of his share of property and for that reason petitioner<\/p>\n<p>                   has been implicated. It is further submitted that the F.I.R.<\/p>\n<p>                   suggests that informant is not the eyewitness as the post<\/p>\n<p>                   mortem report reflects two injuries one on the eye-brow and<\/p>\n<p>                   the other on the occipital region, both injuries are<\/p>\n<p>                   communicating to each other whereas the prosecution side<\/p>\n<p>                   claims three injuries being caused to the victim.<\/p>\n<p>                                 The report of the learned court-below at Flag-&#8216;X&#8217;<\/p>\n<p>                   suggests that no charges having been framed as yet.<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>                       Learned counsel for the petitioner submitted that<\/p>\n<p>       the informant has claimed three fire-arm injuries to the victim<\/p>\n<p>       when the post mortem report reflects only one injury then the<\/p>\n<p>       version of the informant gets clouded.\n<\/p>\n<p>                       However, learned counsel for the State submits<\/p>\n<p>       that the paragraph No. 62 of the case-diary reflects the<\/p>\n<p>       criminal antecedent of all the accused persons. It is submitted<\/p>\n<p>       by learned counsel for the petitioner that petitioner is not<\/p>\n<p>       named in those cases which are referred in the case-diary. It<\/p>\n<p>       is submitted that other two assailants have already been<\/p>\n<p>       granted bail.\n<\/p>\n<p>                       Let the learned court-below verify all those cases<\/p>\n<p>       as referred above, and if the petitioner is not named in the<\/p>\n<p>       F.I.Rs. of those cases then the petitioner shall be released on<\/p>\n<p>       bail on furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>       with two sureties of the like amount each to the satisfaction of<\/p>\n<p>       Addl. Sessions Judge, F.T.C. No. V, Khagaria in connection<\/p>\n<p>       with Sessions Trial no. 102 of 2011 arising out of Parbatta<\/p>\n<p>       P.S.
