Justice P.Q.BARKATH ALI\n\n Dated :14\/06\/2010\n\n O R D E R\n                  A.K.BASHEER &amp; P.Q.BARKATH ALI, JJ.\n\n            --------------------------------------------------\n\n                         M.A.C.A. 1054 of 2004\n\n            ---------------------------------------------------\n\n                        DATED: JUNE 14, 2010\n\n\n\n\n                               JUDGMENT\n<\/pre>\n<p>Basheer, J.\n<\/p>\n<p>     The appellant-company is the insurer of a goods autorickshaw,<\/p>\n<p>which met with an accident while carrying some goods and the owner<\/p>\n<p>thereof, in it.    The Tribunal after considering the claim of the<\/p>\n<p>victim\/owner of the goods, passed an award directing the appellant to<\/p>\n<p>pay a sum of Rs.48,750\/- towards compensation with 9% interest per<\/p>\n<p>annum.\n<\/p>\n<p>     2.     The appellant takes exception to the above award<\/p>\n<p>contending primarily that the Tribunal ought to have exonerated it<\/p>\n<p>from the liability to indemnify the insured\/owner of the vehicle in as<\/p>\n<p>much as;\n<\/p>\n<blockquote><p>     (a) the claimant was not the owner of the goods which was<\/p>\n<p>     allegedly being carried in the goods vehicle, and;<\/p>\n<\/blockquote>\n<blockquote><p>     (b) the owner and driver of the vehicle were not supposed to<\/p>\n<p>     allow the claimant to travel in the said vehicle which did not have<\/p>\n<p>     any provision to accommodate a passenger, be it the owner of<\/p>\n<p><span class=\"hidden_text\">M.A.C.A. 1054 of 2004                2<\/span><\/p>\n<p>       the goods or a gratuitous passenger.\n<\/p><\/blockquote>\n<p>The above contentions were repelled by the Tribunal.          Hence this<\/p>\n<p>appeal.\n<\/p>\n<p>       3. Sri Mathews Jacob, learned senior counsel who appears for<\/p>\n<p>the appellant, lays heavy emphasis on the fact that no provision had<\/p>\n<p>been admittedly made in the goods autorickshaw to accommodate the<\/p>\n<p>owner of the goods as a passenger.        He points out that a goods<\/p>\n<p>autorickshaw is provided only with a driver&#8217;s seat and nothing more.<\/p>\n<p>It is further contended by the learned senior counsel that there was<\/p>\n<p>absolutely no evidence to show that the claimant was the owner of the<\/p>\n<p>goods.\n<\/p>\n<p>       4.   Sec.147(1)(a)(i) of the Motor Vehicles Act deals with the<\/p>\n<p>liability of the insurer to pay compensation against any liability which<\/p>\n<p>may be incurred in respect of the death of or bodily injury to any<\/p>\n<p>person including the owner of the goods or his authorised<\/p>\n<p>representative carried in the vehicle. The above liability of the insurer<\/p>\n<p>in respect of any person, including the owner of the goods in a goods<\/p>\n<p>vehicle was incorporated in the Act, through an amendment in Act 54<\/p>\n<p>of 1994 with effect from November 14, 1994.      Though the appellant<\/p>\n<p>had contended that the claimant was not the owner of the goods, the<\/p>\n<p>Tribunal had repelled the above contention in the absence of any<\/p>\n<p><span class=\"hidden_text\">M.A.C.A. 1054 of 2004                3<\/span><\/p>\n<p>contra evidence adduced by the appellant.\n<\/p>\n<p>      5. As regards the contention about the absence of any seating<\/p>\n<p>provision in the goods autorickshaw to accommodate the owner of the<\/p>\n<p>goods, it has to be noticed that the owner who accompanies his goods<\/p>\n<p>in the vehicle cannot be penalised if the owner or driver of the vehicle<\/p>\n<p>accommodates him in the vehicle in violation of the policy conditions.<\/p>\n<p>Learned senior counsel contends that when no provision has been<\/p>\n<p>made in a goods autorickshaw to accommodate the owner of the<\/p>\n<p>goods, there can be no doubt that the insurer will not be liable to<\/p>\n<p>indemnify the owner of the vehicle. In other words, the contention is<\/p>\n<p>that the appellant\/Insurance Company will have absolutely no liability<\/p>\n<p>since the claimant had chosen to travel in a vehicle which did not even<\/p>\n<p>have a seat provided for such travel.\n<\/p>\n<p>      6.   We are afraid, the above contention is wholly misconceived.<\/p>\n<p>An owner of the goods is entitled to accompany his goods. It may be<\/p>\n<p>true that in a goods autorickshaw no separate seat is provided to<\/p>\n<p>accommodate the owner of the goods while he is accompanying it. He<\/p>\n<p>may, in such a contingency, share the seat of the driver.    But, if the<\/p>\n<p>owner and\/or driver of the insured vehicle accommodates the owner of<\/p>\n<p>the goods in the vehicle, such action can be treated only as a violation<\/p>\n<p>of the policy conditions.\n<\/p>\n<p><span class=\"hidden_text\">M.A.C.A. 1054 of 2004                    4<\/span><\/p>\n<p>       7.   Their Lordships of the Supreme Court in <a href=\"\/doc\/789003\/\">United India<\/p>\n<p>Insurance Co.Ltd. v. Suresh<\/a> {2008 (4) KLT 552 (SC)} has taken such<\/p>\n<p>a view.     The question that came up for consideration in the above<\/p>\n<p>case was whether a person who hired a goods vehicle would come<\/p>\n<p>within the purview of S.147(1) of the Act, although no goods were<\/p>\n<p>being carried at the time of the accident.       While reiterating the well<\/p>\n<p>settled legal position as laid down in <a href=\"\/doc\/75737\/\">National Insurance Co. Ltd. v.<\/p>\n<p>Baljit Kaur<\/a> {(2004) 2 SCC 1} that the term &#8220;any person&#8221; envisaged<\/p>\n<p>under S.147(1)(b)(i) shall not include any gratuitous passenger, their<\/p>\n<p>Lordships held that if the claimant had not been travelling in the<\/p>\n<p>vehicle as owner of the goods, he shall not be covered by the policy of<\/p>\n<p>insurance.    To put it differently, no gratuitous passenger can be<\/p>\n<p>allowed to travel in a goods vehicle and not even the owner of the<\/p>\n<p>vehicle can share the seat of the driver in a goods autorickshaw. But,<\/p>\n<p>it was held that if the owner of the goods is allowed to share the seat<\/p>\n<p>of the driver, it will be only at the risk and peril of the owner\/insured of<\/p>\n<p>the vehicle.\n<\/p>\n<p>       8. For the reasons stated above, the contentions raised by the<\/p>\n<p>appellant in this case are liable to be repelled.     We do so.
