NO\n\t\t\n\t\n\n \n\n \n=========================================================\n\n \n\nSAMIRKHAN\nFARIDKHAN PATHAN THROUGH HIS WIFE JULEKHABANU - Petitioner(s)\n \n\nVersus\n \n\nCOMMISSIONER\nOF POLICE &amp; 2 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMS\nBANNA S DUTTA for\nPetitioners \nMR PRANAV TRIVEDI, AGP  for\nRespondents. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tHeard<br \/>\nlearned advocate for the petitioner and learned AGP for the<br \/>\nrespondents.\n<\/p>\n<p>2.\t\tThe<br \/>\ndetenue   Samirkhan Faridkhan Pathan through his wife Julekhabanu<br \/>\nSamirkhan Pathan has preferred this petition under Article 226 of the<br \/>\nConstitution of India, for appropriate writ, order or direction for<br \/>\nquashing and setting aside the impugned order dated 29.1.2010  passed<br \/>\nby the respondent No.1-Commissioner of Police, Ahmedabad City   in<br \/>\nexercise of power under sub-section (1) of Section 3 of the Gujarat<br \/>\nPrevention of Anti Social Activities Act, 1985 ( PASA Act  for<br \/>\nshort) whereby the petitioner has been detained as a  bootlegger .\n<\/p>\n<p>3.\t\tAlong<br \/>\nwith the detention order, the petitioner detenue has been supplied<br \/>\nwith the grounds of detention. From the grounds of detention, it<br \/>\nappears that one solitary offence being Prohibition CR No.5004 of<br \/>\n2010  has been registered against the detenue.  The said offence has<br \/>\nbeen registered with DCB Police Station, Ahmedabad City   under the<br \/>\nprovisions of the Bombay Prohibition Act. On the basis of<br \/>\nregistration of the said case,  the detaining authority held that the<br \/>\npresent detenue was carrying on activities of selling of  liquor<br \/>\nwhich is harmful to the health of the public. It is held by the<br \/>\ndetaining authority that as the detenue is indulged in illegal<br \/>\nactivities, it is required to restrain the detenue from carrying out<br \/>\nfurther illegal activities, i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offence and<br \/>\nstatements of unnamed witnesses.  In the opinion of this Court, the<br \/>\nactivities of the detenue can, by no stretch of imagination, be said<br \/>\nto be disturbing the  public order.  It is seen from the grounds<br \/>\nof detention that a general statement that has been made by the<br \/>\ndetaining authority that consuming liquor is injurious to health.  In<br \/>\nfact, a perusal of the order passed by the detaining authority shows<br \/>\nthat the grounds which  are mentioned in the order are in reference<br \/>\nto the situation of  law and order  and not  public order .<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling  liquor which is harmful to the health of the<br \/>\npublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of  law and<br \/>\norder  and not  public order .\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.<br \/>\n     In the result, the Special Civil Application is allowed.   The<br \/>\nimpugned order of detention dated 29.1.2010  passed against the<br \/>\ndetenu is hereby  quashed and set aside.  The detenu is ordered to be<br \/>\nset at liberty forthwith,  if  not required in any other case.  Rule<br \/>\nis made absolute accordingly.
