APPEAL NO.792\/2009\n                        (Om Prakash vs. Sonraj)\n\n                     DATE OF ORDER : 10\/7\/2009\n\n              HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.Sajjan Singh, for the appellant.\n\n\n         This appeal is directed against the order dated 20\/2\/2009,\n\nwhereby, learned trial court has allowed the application under Order\n\n39 Rule 1 and 2 CPC restraining the defendant to alienate the suit\n\nproperty further and also to maintain the status quo of the suit\n\nproperty.\n\n         Learned counsel for the defendant submits that this would\n\nprevent the defendant from undertaking any construction of whatever\n\nnature. No occasion, admittedly, has arisen so far. If any such\n\noccasion arises, it goes without saying that defendant is at liberty to\n\nfile appropriate application before the trial court. There is no good\n\nground to interfere with the impugned order dated 20\/2\/2009 at this\n\nstage.\n\n         The present appeal being devoid of merit is dismissed.
