         Kulwant Kaur and Sunveer Kaur had filed Criminal Misc. No.<\/p>\n
M-3773 of 2009 in this Court. The following order was passed by this<\/p>\n
Court on 10.2.2009:-\n<\/p>\n
                              Issue notice of motion to learned Advocate<\/p>\n
                   General, Punjab.\n<\/p><\/blockquote>\n
                              On the asking of the Court Mr. Mehardeep<\/p>\n
                   Singh, learned Advocate General,     Punjab, accepts<\/p>\n
                   notice on behalf of the State.\n<\/p><\/blockquote>\n
 Criminal Writ Petition No. 314 of 2009                                   2<\/span><\/p>\n
\n<\/blockquote>\n
                                Petitioners are stated to be adult and have<\/p>\n
                      attained majority. It is stated that they are competent<\/p>\n
                      to solemnize their marriage. Petitioners         have<\/p>\n
                      grievance that their marriage is not being accepted<\/p>\n
                      by their parents and relatives. They apprehend<\/p>\n
                      danger to their lives.\n<\/p><\/blockquote>\n
                                Senior Superintendent of Police, Patiala,<\/p>\n
                      is directed to give adequate security and protection<\/p>\n
                      to the newly married couple.\n<\/p><\/blockquote>\n
                                Petition is disposed off”.<\/p><\/blockquote>\n
          This petition has been filed by Harbans Kaur and Rajinder<\/p>\n
Singh, parents of Sunveer Kaur under Article 226 of the Constitution of<\/p>\n
India that Sunveer Kaur has been illegally detained by Kulwant Kumar,<\/p>\n
respondent No.3.\n<\/p>\n
          Sunveer Kaur is present in the Court. Her statement has been<\/p>\n
recorded separately. She has stated that she intends to stay with her<\/p>\n
husband Kulwant Kumar.\n<\/p>\n
          Sunita Rani, respondent No.4, first wife of respondent No.3<\/p>\n
Kulwant Kumar is also present in the Court. It has been stated that the<\/p>\n
marriage of Sunveer Kaur with Kulwant Kumar, respondent No.3 is void.<\/p>\n
          Two adult persons can stay together even without effecting<\/p>\n
marriage. If there is threat to their life and they apprehend danger, this<\/p>\n
Court is bound to provide them security.<\/p>\n
          The submissions made by counsel for the petitioners further<\/p>\n
justifie that Sunveer Kaur should be protected so that no harassment is<\/p>\n
caused to her life.\n<\/p>\n
 Criminal Writ Petition No. 314 of 2009                               3<\/span><\/p>\n
         If second marriage is performed by anybody, law take care of<\/p>\n
it. Offence of second marriage (bigamy) is a non-cognizable offence.<\/p>\n
Section 198 Cr.P.C. read as under:-\n<\/p>\n
                   “198.    Prosecution      for    offence     against
\n                            marriage.\n<\/p><\/blockquote>\n
\n                  (1)       No court shall take cognizance of all<\/p>\n
                  offence punishable under Chapter XX of the Indian<\/p>\n
                  Penal Code (45 of 1860) except upon a complaint<\/p>\n
                  made by some person aggrieved by the offence:<\/p>\n
                  Provided that-\n<\/p><\/blockquote>\n
                   (a)       Where such person is under the age of<\/p>\n
                             eighteen years, or is an idiot or a lunatic,<\/p>\n
                             or is from sickness or infirmity unable to<\/p>\n
                             make a complaint, or is a woman who,<\/p>\n
                             according to the local customs and<\/p>\n
                             manners, ought not to be compelled to<\/p>\n
                             appear in public, some other person may,<\/p>\n
                             with the leave of the court, make a<\/p>\n
                             complaint on his or her behalf,<\/p>\n<\/blockquote>\n
                   (b)       Where such person is the husband and he<\/p>\n
                             is serving in any of the Armed Forces of<\/p>\n
                             the Union under conditions which are<\/p>\n
                             certified by his Commanding Officer as<\/p>\n
                             precluding him from obtaining leave of<\/p>\n
                             absence to enable him to make a<\/p>\n
                             complaint in person, some other person

                            authorised by the husband in accordance<\/p>\n
                            with the provisions of sub-section (4) may<\/p>\n
                            make a complaint on his behalf,<\/p>\n<\/blockquote>\n
                  (c)       Where the person aggrieved by an<\/p>\n
                            offence punishable under section 494 or<\/p>\n
                            section 495] of the Indian Penal Code (45<\/p>\n
                            of 1860) is the wife, complaint may be<\/p>\n
                            made on her behalf by her father, mother,<\/p>\n
                            brother, sister, son or daughter or by her<\/p>\n
                            father’s or mother’s, brother or sister, or,<\/p>\n
                            with the leave of the court, by any other<\/p>\n
                            person related to her by blood, marriage<\/p>\n
                            or adoption].\n<\/p><\/blockquote>\n
                  (2)      For the purpose of sub-section (1), no<\/p>\n
                  person other than the husband of the woman, shall<\/p>\n
                  be deemed to be aggrieved by any offence<\/p>\n
                  punishable under section 497 or section 498 of the<\/p>\n
                  said Code:\n<\/p><\/blockquote>\n
                           Provided that in the absence of the<\/p>\n
                  husband, some person who had care of the woman<\/p>\n
                  on his behalf at the time when such offence was<\/p>\n
                  committed may, with the leave of the court, make a<\/p>\n
                  complaint on his behalf.\n<\/p><\/blockquote>\n
                  (3)      When in any case falling under clause (a)<\/p>\n
                  of the proviso to sub-section (1), the complaint is<\/p>\n
                  sought to be made on behalf of a person under the
\n Criminal Writ Petition No. 314 of 2009                                 5<\/span><\/p>\n
                  age of eighteen years or of a lunatic by a person<\/p>\n
                  who has not been appointed or declared by a<\/p>\n
                  competent authority to be the guardian of the person<\/p>\n
                  of the minor or lunatic, and the court is satisfied that<\/p>\n
                  there is a guardian so appointed or declared, the<\/p>\n
                  court shall, before granting the application for leave,<\/p>\n
                  cause notice to be given to such guardian and give<\/p>\n
                  him a reasonable opportunity of being heard.<\/p>\n
                  (4)       The authorization referred to in clause (b)<\/p>\n
                  of the proviso to sub-section (1), shall be in writing,<\/p>\n
                  shall be signed or otherwise attested by the<\/p>\n
                  husband, shall contain a statement to the effect that<\/p>\n
                  he has been informed of the allegations upon which<\/p>\n
                  the   complaint    is   to   be   founded,   shall   be<\/p>\n
                  countersigned by his Commanding Officer, and shall<\/p>\n
                  be accompanied by a certificate signed by that<\/p>\n
                  Officer to the effect that leave of absence for the<\/p>\n
                  purpose of making a complaint in person cannot for<\/p>\n
                  the time being be granted to the husband.<\/p>\n
                  (5)       Any document purporting to be such an<\/p>\n
                  authorization and complying with the provisions of<\/p>\n
                  sub-section (4), and any document purporting to be<\/p>\n
                  a certificate required by that sub-section shall,<\/p>\n
                  unless the contrary is proved, be presumed to be<\/p>\n
                  genuine and shall be received in evidence.<\/p>\n
                  (6)       No court shall take cognizance of an
\n Criminal Writ Petition No. 314 of 2009                                6<\/span><\/p>\n
                   offence under section 376 of the Indian Penal Code<\/p>\n
                   (45 of 1860), where such offence consists of sexual<\/p>\n
                   inter-course by a man with his own wife, the wife<\/p>\n
                   being under fifteen years of age, if more than one<\/p>\n
                   year has elapsed from the date of the commission of<\/p>\n
                   the offence.\n<\/p><\/blockquote>\n
                   (7)       The provisions of this section apply to the<\/p>\n
                   abetment of, or attempt to commit an offence as<\/p>\n
                   they apply to the offence.<\/p><\/blockquote>\n
          Section 198 Cr.P.C. provide as to who can prosecute in case<\/p>\n
of second marriage. The protection given to Sunveer Kaur and Kulwant<\/p>\n
Kumar is only to save their life and liberty. If any party initiate any<\/p>\n
proceedings for any offence made out, law will take its own course.<\/p>\n
          With the observations made above, the present petition is<\/p>\n
disposed off.\n<\/p>\n<\/p>\n
