JUSTICE AJIT KUMAR SINHA\n                                        ---------\n               For the petitioner:      Mr. Ashutosh Choubey, Advocate\n               For the State:           J.C. to S.C.-II\n                                        ---------\n03\/ 11.12.2008<\/pre>\n<p>       This writ petition has been preferred to quash the<br \/>\n               office order vide memo no. 1064 dated 28.12.1998, issued<br \/>\n               under the signature of respondent no.6, whereby, the<br \/>\n               appointment of the petitioner has been cancelled with effect<br \/>\n               from the date of issuance of the order. The aforesaid order<br \/>\n               has been issued in the light of the directions issued by the<br \/>\n               Government in the Department of Rural Development<br \/>\n               Department vide Memo No. 2065 dated 30.5.1998, No.3961<br \/>\n               dated 5.9.1998 as well as letter no.770 dated 26.11.1998,<br \/>\n               issued    under      the        signature    of   Secretary      to     the<br \/>\n               Commissioner, Santhal Pargana Division, Dumka. The<br \/>\n               petitioner has also prayed for quashing the direction<br \/>\n               contained in Memo No. 2065 dated 20.5.1998, issued under<br \/>\n               the signature of Deputy Secretary, Rural Development<br \/>\n               Department, Government of Bihar, Now Jharkhand, and<br \/>\n               Memo No. 3961 dated 5.9.1998 issued under the signature<br \/>\n               of    Engineer-in-Chief         -cum-   Special     Secretary      -cum-<br \/>\n               Additional Commissioner, Rural Engineering Organization,<br \/>\n               Rural      Development             Department,       whereby,           the<br \/>\n               Superintending Engineer, Rural Engineering Organization<br \/>\n               Works Circle, Dumka has been directed to terminate the<br \/>\n               service of the petitioner in compliance of the order passed by<br \/>\n               the High Court.\n<\/p>\n<p>                       Further    prayer       has   been   made    for   a     direction<br \/>\n               commanding upon the respondents to consider the case of<br \/>\n               the   petitioner    for    appointment       to   Class    III   post    of<br \/>\n               Correspondence Clerk in Rural Engineering Works Circle,<br \/>\n               Dumka for which his name was earlier forwarded and<br \/>\n               recommended        by     the    Employment       Exchange,      Dumka.<br \/>\n               Petitioner has also prayed for holding his appointment made<br \/>\n               vide order no.560 dated 17.7.1995 as legal, valid and in<br \/>\n               accordance with law.\n<\/p>\n<p><span class=\"hidden_text\">                                                2.<\/span><\/p>\n<p>                     The   respondents        in    their    counter       affidavit   at<br \/>\n             paragraph no.8 have submitted as under:\n<\/p>\n<p>                    &#8220;That with reference to the statements made in paragraph 3(xi) of<br \/>\n                the writ application under reply, it is stated that as there was only one<br \/>\n                vacancy of Correspondence Clerk in General Category, therefore, the<br \/>\n                petitioner could not be appointed as Correspondence Clerk in Class III<br \/>\n                post whose name had appeared in serial no. (2) of the Merit list in<br \/>\n                General Category. However, his recruitment to Class IV post was done<br \/>\n                on consideration of his application against the vacant post.&#8221;\n<\/p>\n<p>                     The fact remains that the impugned order dated<br \/>\n             28.12.1998 was without any notice and without assigning<br \/>\n             any reason vide which the appointment of the petitioner was<br \/>\n             cancelled on 17.7.1995. It is also an admitted position that<br \/>\n             the appointment of the petitioner was by way of selection<br \/>\n             through Employment Exchange, which meets the test of<br \/>\n             Articles 14 and 16 of the Constitution of India. In paragraph<br \/>\n             no.8 of the counter affidavit, the respondents have also<br \/>\n             submitted that the petitioner&#8217;s name figured at serial no. 2 of<br \/>\n             merit list in General Category and he was recruited to Class<br \/>\n             IV post on his request\/application against a vacant post.\n<\/p>\n<p>                     It does not stand to reason as to on what ground did<br \/>\n             the respondents cancel the appointment of the petitioner<br \/>\n             when he was eligible and selected and the post was<br \/>\n             available. Even otherwise the hurdle of Class III post was<br \/>\n             given a goby because the petitioner himself opted for Class<br \/>\n             IV post and was appointed.\n<\/p>\n<p>                     Considering the aforesaid facts and circumstances of<br \/>\n             the case, the impugned order dated 28.12.1998, issued<br \/>\n             under the signature of respondent no.6, the Superintending<br \/>\n             Engineer, Rural Engineering Organization Works Circle,<br \/>\n             Dumka, is quashed and the writ petition is allowed. The<br \/>\n             respondents are directed to consider the claim of the<br \/>\n             petitioner for appointment on Class IV post in the light of his<br \/>\n             appointment letter dated 17.7.1995.
