Pay duties\n\n\nThe PIO reply:\nNo reply was given to the appellant.\n\nGrounds for the First Appeal:\nNo reply was given to the appellant by the PIO .\n\nOrder of the First Appellate Authority (FAA):\n\"I have considered the application filed by the Appellant; and the appeal dated 03-05-2011 preferred\nby the appellant alleging therein that the information sought vide application date 02-04-2011 has not\nbeen provided by the CPIO, thus the information has been refused as per the RTI Act, 2005.\nCPOI zonal office, Lucknow is directed to immediately furnish information\/suitable reply in terms of\nprovisions of the RTI Act, 2005. In case the CPIO has already furnished the information\/reply to the\nappellant another copy of the same may be sent by registered\/speed post.\"\n\nGround of the Second Appeal:\nNO information had been provided by the PIO and unsatisfactory order was given by the FAA.\n\n\n                                                                                          Page 1 of 2\n Relevant Facts<\/pre>\n
 emerging during Hearing:\n<\/p>\n
The following were present
\nAppellant : Mr. M. K. Sachan on video conference from NIC-Lucknow Studio;
\nRespondent : Absent;\n<\/p>\n
       The appellant states that he has received no information at all from the PIO. Even after the
\norder of the FAA no information has been provided to him.\n<\/p>\n
Decision:\n<\/p>\n
The Appeal is allowed.\n<\/p>\n
      The PIO is directed to provide the complete information to the Appellant before
\n10 November 2011.\n<\/p>\n
The issue before the Commission is of not supplying the complete, required information by the
\nPIO within 30 days as required by the law.\n<\/p>\n
From the facts before the Commission it appears that the PIO is guilty of not furnishing information
\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the
\nrequirement of the RTI Act. He has further refused to obey the orders of his superior officer, which
\nraises a reasonable doubt that the denial of information may also be malafide. The First Appellate
\nAuthority has clearly ordered the information to be given.\n<\/p>\n
It appears that the PIO’s actions attract the penal provisions of Section 20 (1). A showcause notice is
\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty
\nshould not be levied on him.\n<\/p>\n
He will present himself before the Commission at the above address on 23 November 2011 at 4.30pm
\nalongwith his written submissions showing cause why penalty should not be imposed on him as
\nmandated under Section 20 (1). He will also submit proof of having given the information to the
\nappellant.\n<\/p>\n
If there are other persons responsible for the delay in providing the information to the Appellant the
\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before
\nthe Commission with him. If no other responsible persons are brought by the persons asked to
\nshowcause hearing, it will be presumed that they are the responsible persons.\n<\/p>\n
This decision is announced in open chamber.\n<\/p>\n
Notice of this decision be given free of cost to the parties.
\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n
