SEEKING TO ENLARGE THE PETITIONER ON BAIL\nIN KAMARIPETH P S CRIME 22\/2013 AND IN CC\n                                 2\n\n\n\n\nNO.1463\/2013 PENDING ON THE FILE OF J.M.F.C-II\nCOURT AT HUBLI DIST: DHARWAD FOR THE OFFENCE\nPUNISHABLE UNDER SECTION 307 AND 436 OF IPC.\n\n    THIS PETITION COMING ON FOR ORDERS THIS DAY, THE\nCOURT MADE THE FOLLOWING:\n\n                          ORDER\n<\/pre>\n<p>     A charge sheet has been filed against the petitioner<\/p>\n<p>making allegations that on 6\/4\/2013 at about 5.30 pm, the<\/p>\n<p>accused-petitioner went to the pan shop of the complainant<\/p>\n<p>by name Mujpal Abdul Ajiz, with a bottle of petrol, he blowed<\/p>\n<p>the petrol on the face of the complainant and lit the fire, due<\/p>\n<p>to which the complainant has suffered 20-30% of burn<\/p>\n<p>injures to his face and other parts of his body.          In the<\/p>\n<p>complaint, it is not stated what was the reason for the<\/p>\n<p>accused to do that particular act. Whether there was any ill<\/p>\n<p>will or hatred between the complainant and the accused.<\/p>\n<p>The charge sheet papers also disclose that the injured was<\/p>\n<p>admitted in the hospital and subsequently discharged. The<\/p>\n<p>said certificate also shows that he suffered grievous injury.<\/p>\n<p>There is absolutely no mention in the injury certificate that<\/p>\n<p>the said injuries are fatal in nature. There is no life threat so<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>far as complainant is concerned. The petitioner was arrested<\/p>\n<p>on 6\/4\/2013 and since then he has been in judicial custody.<\/p>\n<p>He is no more required for any further interrogation,<\/p>\n<p>investigation etc.<\/p>\n<p>      2. Under the above said circumstances, at this stage, it<\/p>\n<p>is very difficult to draw an interference that he had any illicit<\/p>\n<p>intention to kill the complainant as such.      That has to be<\/p>\n<p>established during the course of full dressed trial.<\/p>\n<p>      3. Under the above said facts and circumstances of the<\/p>\n<p>case, it is just and necessary to release the petitioner on bail.<\/p>\n<p>The trial Court has dismissed the petition on the ground that<\/p>\n<p>the petitioner has suppressed before the Court, the rejection<\/p>\n<p>of previous bail petition by the same Court.           But, this<\/p>\n<p>particular aspect may not be in straight jacket manner<\/p>\n<p>attributed to the accused, because it is the duty of the<\/p>\n<p>counsel who appear for the accused to ascertain what<\/p>\n<p>happened to the previous bail petition. Under the above said<\/p>\n<p>circumstances, that cannot be a ground to reject the bail<\/p>\n<p>petition if he is otherwise entitled to.\n<\/p>\n<p><span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>     Hence, the following order is passed:-\n<\/p>\n<\/p>\n<p>                             ORDER<\/p>\n<p>     Petition filed under Section 439 of Cr.P.C. is hereby<\/p>\n<p>allowed.    Consequently, the petitioner shall be released on<\/p>\n<p>bail subject to the following conditions:<\/p>\n<blockquote><p>     i)     The petitioner shall execute a personal bond for a<\/p>\n<p>            sum of Rs.50,000\/- with one solvent surety for<\/p>\n<p>            the likesum to the satisfaction of the Committal<\/p>\n<p>            Court \/ trial Court as the case may be.<\/p>\n<\/blockquote>\n<blockquote><p>     ii)    The petitioner shall not indulge in hampering the<\/p>\n<p>            investigation    or       tampering   the   prosecution<\/p>\n<p>            witnesses.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>     iii)   He shall attend Committal \/ trial Court on all<\/p>\n<p>            future hearing dates unless prevented by any<\/p>\n<p>            genuine cause.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>     iv)    The petitioner shall not leave the jurisdiction of<\/p>\n<p>            the trial Court without prior permission of the<br \/>\n<span class=\"hidden_text\">                        5<\/span><\/p>\n<p>      Court till the case registered against him is<\/p>\n<p>      disposed of.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                               SD\/-<\/p><\/blockquote>\n<p>                              JUDGE<br \/>\nVmb\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Karnataka High Court Aslam Sab Mehaboobsab Ramadurg vs The State Of Karnataka on 28 February, 2014 Author: K.N.Phaneendra 1 IN THE HIGH COURT OF KARNATAKA DHARWAD BENCH DATED THIS THE 28TH DAY OF FEBRUARY, 2014 BEFORE THE HON&#8217;BLE MR.
