The respondent was discharged from<br \/>\nthe service on account of alleged misconduct committed by him.  Being<br \/>\naggrieved by the same, the respondent raised a dispute which was<br \/>\nultimately referred to the Labour Court for adjudication being<br \/>\nReference [LCA) No. 374 of 2002. Before the Labour Court, both the<br \/>\nparties adduced evidence and after appreciating the material produced<br \/>\nbefore it, the Labour Court allowed the reference with the aforesaid<br \/>\ndirections. Hence, these petitions.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.  The learned counsel for the petitioner Company states<br \/>\nthat the respondent workman had attained the age of superannuation on<br \/>\n19.10.2005. Therefore, the only question which is required to be<br \/>\nconsidered is with regard to retirement dues and the back wages.\n<\/p>\n<p>5.\t\tNow<br \/>\nso far as the question of back wages is concerned,<br \/>\nthe Labour Court has not given any cogent reasons for awarding back<br \/>\nwages to the respondent workman. In view of the principle laid down<br \/>\nby the Apex Court in the case of <a href=\"\/doc\/800069\/\">Ram<br \/>\nAshrey Singh v. Ram Bux Singh<\/a><br \/>\nreported in (2003)<br \/>\nII L.L.J. 176<br \/>\na workman has no automatic entitlement to back wages since it is<br \/>\ndiscretionary and has to be dealt with in accordance with the facts<br \/>\nand circumstances of each case. Similar principle has been laid down<br \/>\nby the Apex Court in the case of <a href=\"\/doc\/1628125\/\">General<br \/>\nManager, Haryana Roadways v. Rudhan Singh<\/a><br \/>\nreported in J.T.\n<\/p>\n<p>2005(6) SC 137 [2005(5) SCC 591],<br \/>\nwherein it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but a host of factors are<br \/>\nto be taken into consideration before passing any such order.\n<\/p>\n<p>6.\t\tIt<br \/>\nwould also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/309814\/\">A.P. State Road Transport &amp; Ors. v. Abdul Kareem<\/a><br \/>\nreported in (2005) 6 SCC 36, wherein it has been held that a<br \/>\nworkman is not entitled to any consequential relief on reinstatement<br \/>\nas a matter of course unless specifically directed by forum granting<br \/>\nreinstatement. In above view of the matter, I am of the opinion that<br \/>\nthe respondent cannot be said to be entitled for back wages.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, the following order is passed :\n<\/p>\n<p>(i)\t\tSpecial<br \/>\nCivil Application No. 2261 of 2004 preferred by the petitioner<br \/>\nCompany is partly allowed to the extent that the impugned award<br \/>\ngrating back wages is quashed and set aside. As the respondent<br \/>\nworkman had attained the age of superannuation, the impugned award<br \/>\nqua reinstatement with continuity of service is confirmed and the<br \/>\npetitioner shall pay the retiral benefits to the respondent<br \/>\naccordingly. It is, however made clear that the petitioner Company<br \/>\nshall pay the retiral benefits to the respondent workman within a<br \/>\nperiod of four months from the date of receipt of writ of this order<br \/>\nand shall pay the same on the basis of the last drawn wages.  Rule is<br \/>\nmade absolute to the above extent with no order as to costs.\n<\/p>\n<p>(ii)\t\tSpecial<br \/>\nCivil Application No. 4050 of 2004 preferred by the petitioner<br \/>\nworkman is dismissed. Rule is discharged.
