          In this Petition filed under Sec. 438 Cr.P.C. the petitioner who   is the<\/p>\n
accused   in   O.R.   No.63\/2005     of   Alappuzha   Excise   Range     for     offences<\/p>\n
punishable   under   sections   8(1)   and   8(2)       of   the   Abkari   Act   for   allegedly<\/p>\n
having been found in possession of  3 litres of illicit arrack  seeks anticipatory<\/p>\n
Bail.\n<\/p>\n<\/p>\n
          2.    The learned Public Prosecutor  opposed the application.<\/p>\n
          3.    Anticipatory   bail   cannot   be   granted   in   a   case   involving   such<\/p>\n
grave offence.   It is too early to accept the petitioner’s contention that the<\/p>\n
petitioner   has   been   falsely   implicated.             There   is   no   reason   why   the<\/p>\n
petitioner   should   not   surrender   before   the   Magistrate   concerned   and   seek<\/p>\n
regular bail.   Accordingly if the petitioner surrenders before the   Magistrate<\/p>\n
concerned within two weeks  from today  and files an application for regular<\/p>\n
bail, the same shall be considered  and disposed  of preferably on the same<\/p>\n
day on which it is filed, bearing in mind the decision in Sukumari  v.  State<\/p>\n
of Kerala<\/a>  (2001 (1)  KLT  22).\n<\/p>\n<\/p>\n
          With the above observation this Application is   disposed of.<\/p>\n
