Justice R.BASANT\n\n Dated :26\/02\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                            Crl.M.C.No.225 of 2007\n\n                         -------------------------------------\n\n                  Dated this the 26th day of February, 2007\n\n\n                                       ORDER\n<\/pre>\n<p>       The   petitioner   is   the   2nd  accused   in   a   prosecution   under   the<\/p>\n<p>provisions of the Kerala Abkari Act.  The crux of the allegations is that<\/p>\n<p>a   vehicle-a  Uno  car   was  used  by   the  two  accused  persons   to  illicitly<\/p>\n<p>transport   the   contraband   liquor   without   any   legal   authority.     The<\/p>\n<p>vehicle   was   attempted   to   be   stopped.     It   was   not   stopped.     After   a<\/p>\n<p>chase, the vehicle was stopped.   But the driver took to his heels and<\/p>\n<p>no one could be arrested.\n<\/p>\n<\/p>\n<p>       2.      Investigation   allegedly   reveals   that   the   vehicle   originally<\/p>\n<p>belonged   to   a   registered   owner,   who   expired   prior   to   the   date   of<\/p>\n<p>detection  of   the  crime.    After   the death  of   the  deceased,   the vehicle<\/p>\n<p>was allegedly repossessed by the petitioner as the Managing Director<\/p>\n<p>of the financier, who had entered into the agreement of hire purchase.<\/p>\n<p>Thereupon, secret chambers were allegedly built in the car by the two<\/p>\n<p>accused   persons   as   per   prior   concert   between   them.     They   had<\/p>\n<p>misused   the   vehicle   for   illicit   transportation   of   contraband   articles<\/p>\n<p>violating the provisions of the Kerala Abkari Act.   This in short is the<\/p>\n<p>allegation.\n<\/p>\n<\/p>\n<p>       3.      The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>petitioner   has   been   arrayed   as   an   accused   without   any   sufficient<\/p>\n<p>reason.     There  is  no  specific   and   forthright  statement   as   to  whether<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.225 of 2007                      2<\/span><\/p>\n<p>the   vehicle   has   been   repossessed   after   the   death   of   the   deceased-<\/p>\n<p>registered owner and what has been done with the vehicle after such<\/p>\n<p>alleged repossession if any.  In the absence of satisfactory explanation<\/p>\n<p>forthcoming, at this stage of the proceedings, I am of opinion that it is<\/p>\n<p>not   necessary   for   this   Court   to   delve   deep   into   the   nature   of   the<\/p>\n<p>contention  regarding   the  ownership   and   misuse  of   the   vehicle.     It   is<\/p>\n<p>certainly   for   the   petitioner   to   raise   appropriate   contentions   to   claim<\/p>\n<p>discharge under Section 227 Cr.P.C.  Even the mere possibility of the<\/p>\n<p>accused   being   entitled   to   discharge   or   acquittal   at   later   stages   of<\/p>\n<p>trial, cannot and need not persuade this Court to invoke powers under<\/p>\n<p>Section 482 Cr.P.C to bring to a premature termination a prosecution<\/p>\n<p>validly instituted.  I am not  persuaded to agree from the nature of the<\/p>\n<p>facts   and   circumstances   which   have   presently   been   brought   to   my<\/p>\n<p>notice   that   the   extraordinary   inherent   jurisdiction   available   to   this<\/p>\n<p>Court under Section 482 Cr.P.C can or deserve to be invoked.<\/p>\n<p>         4.    This Crl.M.C is, in these circumstances, dismissed.
