DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the applicants submits that one of the<br \/>\n\tco-accused was enlarged on bail by this Court and the matter between<br \/>\n\tthe parties on civil side has resulted into an amicable settlement.<br \/>\n\tIt is further submitted that the applicant will not<br \/>\n\tflee from justice and will cooperate with the investigation as and<br \/>\n\twhen called for. It is further submitted that in view of the above,<br \/>\n\tthe applicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences,<br \/>\n\twithout discussing the evidence in detail, at this stage, I am<br \/>\n\tinclined to enlarge the applicant on bail  in connection with<br \/>\n\tC.R.No.I-179\/2010 of Rajkot Taluka  Police Station  for the offences<br \/>\n\tpunishable under sections 406, 420, 419, 465, 467, 468, 471 &amp;<br \/>\n\t120(B) of the Indian Penal Code, on furnishing   bond of Rs.10,000\/-<br \/>\n\t(Rupees ten thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
