No.44835 of 2010\n               RAM YASH SAFI son of Ranvir Rajak @ Ranvir Safi\n                                   Versus\n                          THE STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>2\/   16.03.2011                  Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                 The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under sections 394, 411 and 120-B of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                                 It has been submitted that the petitioner is not named in<\/p>\n<p>                   the First Information Report nor is there any recovery from his<\/p>\n<p>                   possession.\n<\/p>\n<p>                                 Considering the same, let the petitioner, above named,<\/p>\n<p>                   be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                   thousand) with two sureties of the like amount each or any other<\/p>\n<p>                   surety to be fixed by the court below to the satisfaction of Sri<\/p>\n<p>                   Prabhakar     Jha,   Judicial   Magistrate,    1st   class,   Jhanjharpur,<\/p>\n<p>                   Madhubani, in connection with Phulparas P.S. Case No.2 of 2009,<\/p>\n<p>                   subject to the conditions (i) That one of the bailors will be a close<\/p>\n<p>                   relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                   genealogy as to how he is related with the petitioner and another<\/p>\n<p>                   bailor shall be the father of the petitioner. The bailors will undertake<\/p>\n<p>                   to furnish information to the court about any change in the address<\/p>\n<p>                   of the petitioner, (ii) That the bailors shall also state on affidavit that<\/p>\n<p>                   they will inform the court concerned if the petitioner is implicated in<\/p>\n<p>                   any other case of similar nature after his release in the present case<\/p>\n<p>                   and thereafter the court below will be at liberty to initiate the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       proceeding for cancellation of bail on the ground of misuse, (iii)<\/p>\n<p>       That the petitioner will give an undertaking that he will receive the<\/p>\n<p>       police papers on the given date and be present on date fixed for<\/p>\n<p>       charge and if he fails to do so on two given dates and delays the trial<\/p>\n<p>       in any manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>       misuse, and (iv) That the petitioner will be well represented on each<\/p>\n<p>       date and if he fails to do so on two consecutive dates, his bail will be<\/p>\n<p>       liable to be cancelled.\n<\/p>\n<p>                   In view of the antecedents of the petitioner, the<\/p>\n<p>       petitioner is directed to appear before the Superintendent of Police,<\/p>\n<p>       Madhubani, within fifteen days of his release with a copy of this<\/p>\n<p>       order and every two weeks thereafter for the next nine months. The<\/p>\n<p>       conduct of the petitioner will be kept under watch in this period by<\/p>\n<p>       the Superintendent of Police concerned and if it is found wanting in<\/p>\n<p>       any respect, a report shall be made to the court concerned by him to<\/p>\n<p>       initiate a proceeding for cancellation of bail for reasons of misuse of<\/p>\n<p>       bail.
