DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP waives service of rule.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that the offences<br \/>\n\talleged against the applicant are Magistrate triable and considering<br \/>\n\tthe  nature of allegations and role attributed to the<br \/>\n\tapplicant, by imposing suitable conditions,  the applicant may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail  in connection with C.R.No.I-122\/2011 of J.P.Road Police<br \/>\n\tStation  for the offences punishable under sections 394, 511 &amp;<br \/>\n\t114 of the Indian Penal Code, on furnishing   bond of Rs.10,000\/-<br \/>\n\t(Rupees ten thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>[h]\tshall not<br \/>\nenter district and city limits of Vadodara for a period of 3 months<br \/>\nexcept for marking presence and attending trial.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
