Misc. No.17598 of 2010\n                      SK.SAHABUDDIN, son of Late Sk. Rajak\n                                      Versus\n                             THE STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>3\/   18.8.2010                  Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                The petitioner seeks bail in a case instituted for the<\/p>\n<p>                    offence under sections 3767, 354, 341, 323 and 504 of the Indian<\/p>\n<p>                    Penal Code.\n<\/p>\n<p>                                Considering that the petitioner is in custody since<\/p>\n<p>                  21.7.2009 as also the relationship between the parties, let the petitioner,<\/p>\n<p>                  above named, be released on bail on furnishing bail bond of<\/p>\n<p>                  Rs.5,000\/- (Five thousand) with two sureties of the like amount each<\/p>\n<p>                  to the satisfaction of the Additional Sessions Judge-cum- Fast Track<\/p>\n<p>                  Court No. IV, Bettiah, in connection with S. Tr. No.560 of 2009<\/p>\n<p>                  arising out of Mainatand P.S. case no.23 of 2007, subject to the<\/p>\n<p>                  conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                  petitioner, who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                  related with the petitioner. The bailors will undertake to furnish<\/p>\n<p>                  information to the court about any change in the address of the<\/p>\n<p>                  petitioner, (ii) That the affidavit shall clearly state that the petitioner<\/p>\n<p>                  is not an accused in any other case and, if he is, he shall not be<\/p>\n<p>                  released on bail, (iii) That the bailors shall also state on affidavit that<\/p>\n<p>                  they will inform the court concerned if the petitioner is implicated in<\/p>\n<p>                  any other case of similar nature after his release in the present case<\/p>\n<p>                  and thereafter the court below will be at liberty to initiate the<\/p>\n<p>                  proceeding for cancellation of bail on the ground of misuse, (iv) That<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>       the petitioner will give an undertaking that he will receive the police<\/p>\n<p>       papers on the given date and be present on date fixed for charge and if<\/p>\n<p>       he fails to do so on two given dates and delays the trial in any<\/p>\n<p>       manner, his bail will be liable to be cancelled for reasons of misuse,<\/p>\n<p>       (v) That the petitioner will be well represented on each date and if he<\/p>\n<p>       fails to do so on two consecutive dates, his bail will be liable to be<\/p>\n<p>       cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                             (Anjana Prakash, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sk.Sahabuddin vs The State Of Bihar on 18 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
