3. By the impugned judgment and order, the<\/p>\n
Commissioner has granted compensation of ?’.2,54, 148\/– with<\/p>\n
interest at 12% p.a. from thirty days after the accident.V_:<\/p>\n
4. Aggrieved by that, the  <\/p>\n
Company has \ufb01led this appeal.\n<\/p>\n
5. In brief, the facts are:\n<\/p>\n
The 1st respondent was working as ” a. driver i’nv”the”mini”‘<\/p>\n
lorry bearing No.KA–l3..~Aw266——- lo_e.lo’nging  to .\/ithe 2nd<\/p>\n
respondent. That on   p.m., when<\/p>\n
the 1st ;a\u00a2sp’o1iden{h:t’l;V to Bangalore, near
\nHeggadihalli’-gat.e,l tlie No.AP–31–W-3588 collided
\nwith the r:r=i,ni  18$ respondent. As a result of
\n  1.51′  sustained injuries and claimed<\/p>\n
conipeV11_satioVn…. ”  Commissioner has awarded a sun: of<\/p>\n
\u00a7’.~withllinterest at 12% pa from thirty days after<\/p>\n
 Aggrieved by that, the appellant- Insurance<\/p>\n
  C’crnpVariyArhas \ufb01led this appeal.<\/p>\n
V.\n<\/p>\n<\/p>\n
6. The learned counsel for the appe1lant–Ins_1,1’rance<\/p>\n
Company contended that the Commissioner has<\/p>\n
taking the loss of earning capacity of the 151 <\/p>\n
50%. He also submitted that the doctorhas   the ‘V’ ‘C<\/p>\n
181 respondent has suffered disabilityloi  inrespect’<\/p>\n
right lower limb and in respect”‘~.of the  the’?<\/p>\n
disability 10% and the Co’mxmissioIie_r:’ llha’vE.\u00bb~taken the
\nloss of earning capacity atllll\ufb01\u00e9fg  that the
\nCommissioner   at 12% per
\nannum from    accident and the
\nCornmissioner  the interest at ’71\/2 per
\nannum from  till the date of award and<\/p>\n
thereafter, ., at  per’  from the date of award till the<\/p>\n
 oVf”‘payrhent.,&He, ltherefore, submitted that the impugned<\/p>\n
judgement order cannot be sustained in law.<\/p>\n
 As against this, the learned counsel for the 13*<\/p>\n
‘submitted that the Commissioner on proper<\/p>\n
 cons.i_de–ration of the material on record has rightly taken the<\/p>\n
loss of earning capacity of the first respondent at  He<\/p>\n
also submitted that IS’ respendent has suffered ._of<\/p>\n
right femur, tibia and fibula and the doctor <\/p>\n
the 13* respondent has suffered perrnanrent ciisabjiiityxof.f50% <\/p>\n
in respect ef the right lower   <\/p>\n
Commissioner has taken the   of the<\/p>\n
first respondent at 50% wiiieh and therefore, it does<\/p>\n
not call for interference.\n<\/p>\n
8. I have__”ca:;ief11lij}’- Qconsidered’ t’her”subrnissions made<\/p>\n
by the learned ‘partiesf<\/p>\n
9.   of law that arises for<\/p>\n
_cor1sidera_tion is, “H\/hetherttfte Commissioner was justified in<\/p>\n
  ig.sswofedrn.i1*1g”Capaeity of the 13′ respondent at 50%<\/p>\n
and interest at 12% per annum from 30 days after<\/p>\n

IO.’ ..  is relevant to note, the 15\u00a2 respondent has<\/p>\n
Suf:Tbr,ed””~fracture of right femur, tibia and fibula and other<\/p>\n

\ninjuries. The doctor has deposed that the 131 respondent has<\/p>\n
suffered permanent disability of 50% in respect of the right
\nlower limb and the first respondent is unable to
\nactivities. In his crosswexamination. the _
\n   hicziup\ufb01\u00e9\ufb01y’
\nthat the whoie body disability is   1
\nnot assessed. The Commissioner:’\u00bb,has”talteri  0.
\nearning capacity at 50% Which”i_s~..o.n
\ncircumstances of the case, it  to  loss of
\nearning capacity at 30%.\n<\/p>\n
1 1. If the loss of  at 30% and<\/p>\n
relevant fa’ctor  to 60% of the wages i.e..<\/p>\n

   days after the accident, which is not<\/p>\n
 corrects”  Commissioner should have awarded interest at<\/p>\n
 date of application tiii the date of award and<\/p>\n
  at 12% per annum from the date of award tiil the<\/p>\n
date of payment as held in Oriental Insurance Company<\/p>\n

13. Accordingly, the appeal is  V   <\/p>\n
