SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/03\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tHeard<br \/>\nMr.Prashant Desai, learned advocate for Mr.Mrugen Purohit, learned<br \/>\nadvocate appearing on behalf of the applicant- original appellant<br \/>\nplaintiff and Mr.Neeraj Soni, learned Assistant Government Pleader<br \/>\nappearing on behalf of the State and other respondents.\n<\/p>\n<p>2.\t\tCivil<br \/>\nApplication No.10362 of 2009 has been preferred by the applicant<br \/>\noriginal appellant of Second Appeal No.256 of 2009 to stay the<br \/>\nimplementation and execution of the judgement and decree passed by<br \/>\nboth the Courts below and to restrain the respondents from taking<br \/>\ncoercive steps against the applicant and to permit the applicant to<br \/>\ncontinue with the business and ownership of control shop till final<br \/>\nhearing and disposal of the Second Appeal.\n<\/p>\n<p>3.<br \/>\nCivil Application No.1994 of 2010 has been preferred by the<br \/>\napplicants   original respondents to vacate the interim relief<br \/>\ngranted by this Court in Civil Application No.10362 of 2009 on<br \/>\n03\/02\/2010.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe facts and circumstances of the case and considering the fact that<br \/>\n main Second  Appeal is already  admitted, ad-interim relief granted<br \/>\nearlier in Civil Application No.10362 of 2009, which came to be<br \/>\nextended from time to time is hereby directed to be continued till<br \/>\nfinal disposal of the Second Appeal. However, in the facts and<br \/>\ncircumstances of the case and with the consent of learned advocates<br \/>\nappearing on behalf of the respective parties, Registry is directed<br \/>\nto notify Second Appeal No.256 of 2009 for final hearing on<br \/>\n10\/03\/2010 in the first board. Appellant to supply paper-book on or<br \/>\nbefore 09\/03\/2010. With this, Civil Application No.10362 of 2009 is<br \/>\ndisposed of. Rule is made absolute to the aforesaid extent.
