Code and Section 25(1)(b) of the Arms Act.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate for the applicant and learned APP for the<br \/>\n\trespondent. Learned Advocate, appearing for the applicant has<br \/>\n\tcontended that there is not an iota of evidence against the<br \/>\n\tapplicant and he is arrested only on the basis of doubt and on the<br \/>\n\tstatement of co-accused. He has contended that the   applicant is<br \/>\n\tinnocent and has not committed any offence, alleged against him.  He<br \/>\n\thas also contended that looking to the facts of the case the<br \/>\n\tapplicant may be released on bail by imposing suitable conditions.<br \/>\n\tLearned APP has vehemently opposed this application.\n<\/p>\n<p>Having<br \/>\n\theard the learned Advocate for the parties and looking to the facts<br \/>\n\tof the case and the fact that now the charge-sheet is filed and,<br \/>\n\ttherefore, without entering into the merits of the case, I am<br \/>\n\tinclined to grant this application. Both the parties do not press<br \/>\n\tfor reasoned order.\n<\/p>\n<p>Considering<br \/>\n\tthe above, this Application is allowed. The applicant is ordered to<br \/>\n\tbe released on bail in connection with CR No. I &#8211; 09 of 2011<br \/>\n\tregistered with Kamrej Police Station, Surat for the offence alleged<br \/>\n\tagainst him in this application on his executing a Bond of<br \/>\n\tRs.10,000\/- (Rupees ten thousand only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the trial Court and subject<br \/>\n\tto the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nconcerned Sessions Judge.\n<\/p>\n<p>f)\tshall<br \/>\nmark his presence before the concerned Investigating Officer on 15th<br \/>\nof every English calender month during 11.00 AM and 2.00 PM till the<br \/>\ntrial, against him, is completed;\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>i)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>6.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute.
