M 4341 of 2009\n\n                                    DATE OF DECISION 19.5.2009\n\nArun\n\n                                                   ......PETITIONER\n                           VERSUS\n\nState of Haryana .\n                                                   ......RESPONDENTS\n\nPRESENT:        Mr. RS Chauhan, Advocate\n                Mr. SS Goripuria, DAG, Hry\n\n\n\nM.M.S.BEDI,J.\n<\/pre>\n<p>             The petitioner is alleged to be a member of an unlawful<\/p>\n<p>assembly, which had attacked Ram Phal with different weapons, resulting<\/p>\n<p>in his death as per the case lodged at the instance of his brother Multan<\/p>\n<p>Singh complainant. The petitioner is alleged to have inflicted a lathi blow on<\/p>\n<p>the person of the deceased.\n<\/p>\n<p>             Learned counsel for the petitioner has submitted that the<\/p>\n<p>petitioner is a young man of 19 years of age and is a student having been<\/p>\n<p>falsely implicated in the case.\n<\/p>\n<p>             I have heard learned counsel for the petitioner and gone<\/p>\n<p>through the nature of the allegations against the petitioner that he had<\/p>\n<p>attacked deceased Ram Phal with a lathi. Learned counsel for the<\/p>\n<p>petitioner submits that a lathi has been planted in this case, which is not<\/p>\n<p>good enough to cause the injury on the person of the deceased.<\/p>\n<p>             In view of the specific part having been attributed to the<\/p>\n<p>petitioner and he being a member of an unlawful assembly, whose liability<\/p>\n<p>is conjoined with the other accused, it will not be appropriate to grant the<br \/>\n<span class=\"hidden_text\"> Cr.Misc. NO. M 4341 of 2009                       2<\/span><\/p>\n<p>concession of bail to the petitioner.\n<\/p>\n<p>             Without expression of any opinion on the facts and<\/p>\n<p>circumstances of the case, the petition is dismissed.<\/p>\n<p>             Anything said in the order will not prejudice the right of the<\/p>\n<p>petitioner during trial.
