SANKARAN, J.\n                      ---------------------------\n                      B.A. No. 863 of 2010\n                  ------------------------------------\n               Dated this the 2nd day of March, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioner is the accused<\/p>\n<p>in Crime No.14\/2010 of Peringome Police Station, Kannur District.<\/p>\n<p>      2.    The offences alleged against the petitioner are under<\/p>\n<p>Sections 447 and 326 of the Indian Penal Code.<\/p>\n<p>      3.    The prosecution case is that on 09.01.2010 at 9.P.M.,<\/p>\n<p>the petitioner attacked the de facto complainant with a wooden<\/p>\n<p>reaper. The de facto complainant sustained &#8220;fracture of middle<\/p>\n<p>third of ulna&#8221;.   The de facto complainant was admitted in the<\/p>\n<p>Pariyaram Medical College hospital.           The First Information<\/p>\n<p>Statement shows that there was a quarrel between the de facto<\/p>\n<p>complainant and the petitioner, when the de facto complainant<\/p>\n<p>asked the petitioner to reduce the volume of T.V during midnight.<\/p>\n<p>There was exchange of words between the parties. It is alleged<\/p>\n<p>that the petitioner attacked the de facto complainant resulting in<\/p>\n<p>the fracture as aforesaid.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 863 of 2010                2<\/span><\/p>\n<p>      4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the injury and the allegations levelled against<\/p>\n<p>the petitioner, I am not inclined to grant anticipatory bail to the<\/p>\n<p>petitioner.     If anticipatory bail is granted tot he petitioner, it<\/p>\n<p>would adversely affect the proper investigation of the case,<\/p>\n<p>      For the aforesaid reasons, the Bail Application is dismissed.<\/p>\n<p>      The learned counsel for the petitioner submitted that the de<\/p>\n<p>facto complainant has political influence and that if the petitioner<\/p>\n<p>is arrested, there is every chance of the petitioner being<\/p>\n<p>manhandled by the police. It is also submitted that the petitioner<\/p>\n<p>and the de facto complainant are neighbours and the petitioner<\/p>\n<p>intends to explore the possibilities of a settlement. In the facts<\/p>\n<p>and     circumstances of the case, to facilitate the settlement<\/p>\n<p>between the parties, there will be a direction to the Sub Inspector<\/p>\n<p>of Police, Peringome Police Station not to arrest the petitioner in<\/p>\n<p>connection with Crime No. 14\/2010 for a period of three weeks<\/p>\n<p>from today.\n<\/p>\n<p>    Hand over copy to both sides.\n<\/p>\n<\/p>\n<p>                                    K.T.
