DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\t \n\nDate\n\t: 05\/05\/2010 \n\t\n\t \n\nORAL\n\tORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 482 of the Code of Criminal<br \/>\n\tProcedure for quashing of complaint being CR No. I- 332 of 2005<br \/>\n\tregistered at Adalaj Police Station for the offences punishable<br \/>\n\tunder Sections 405(1), 406, 409 and 114 of the IPC for default on<br \/>\n\tthe part of the applicants in not paying Rs.12,26,826\/- in the<br \/>\n\tOffice of the Provident Fund.\n<\/p>\n<p>The<br \/>\n\tquashment was sought on account of fact that there was no intention<br \/>\n\tto wrongfully withholding the amount. There was some delay in making<br \/>\n\tpayment.\n<\/p>\n<p>Learned<br \/>\n\tcounsel Ms. E.Shailaja appearing for the respondent No. 2 submits<br \/>\n\tthat she has received instructions that the payment has already been<br \/>\n\tpaid.\n<\/p>\n<p>Learned<br \/>\n\tsenior counsel Shri N.D. Nanavaty appearing for the applicants<br \/>\n\tensures this Court that in future, the payment shall be made<br \/>\n\tregularly and an undertaking to this effect shall also be filed<br \/>\n\tbefore this Court with a copy to the counsel to the other side by<br \/>\n\tthe applicants that in future regularly the Provident Fund amount<br \/>\n\tshall be deposited by the applicants.\n<\/p>\n<p>In<br \/>\n\tview of this, the matter deserves to be disposed of as no useful<br \/>\n\tpurpose shall be served in prosecuting the applicants, especially<br \/>\n\twhen the payment outstanding has already been paid and an assurance<br \/>\n\tis given to this court that in future no such default was occurred<br \/>\n\tand an undertaking is to be filed. The applicants shall file an<br \/>\n\tundertaking within a week from today. The same shall be taken and<br \/>\n\tkept on record. In view of this, the Complaint being CR No. I-332 of<br \/>\n\t2005 registered at Adalaj Police Station for the offences punishable<br \/>\n\tunder Sections 405(1), 406, 409 and 114 of the IPC, does not deserve<br \/>\n\tto be proceeded with and  deserve to be quashed and is accordingly<br \/>\n\tquashed qua applicants.
